Flight Delay and Will Miss Transatlantic Cruise

  1. Not an attorney but it seems to me that I have read of non disclosure agreements. If the OP was compensated in some real way for the days missed, perhaps such an agreement was signed? I don't mean pixie dust like a plush for the children but actual compensation. In that case, we may never hear. But it certainly sounds like they should have made it onboard in Boston. Hope they had a great cruise.
I was thinking this too.

I dont get it first you are paying DISNEY if the flight days scare you tell them to change it, second when you fly in the day of the cruise its a crap shot, Third this is why they sell insurance.

I disagree. Delta's only responsibility would be to get them to Orlando on the next flight....not to Boston and then put them up at a hotel! This is a Disney screw up for sure. They should never have booked or allowed the OP to book with such little time in between arrival in Orlando and sail away!

This was not a regular airline ticket. This was an airline ticket purchased by Disney from Delta on behalf of the cruisers, under the contract between Disney and Delta. Disney didn't pick the flight times, Delta did. What the contract covers is Delta's obligation to get the cruisers to the destination in time to get on the ship before it sails. If it cannot do that, it is Delta's obligation to get them to the next port that they may legally embark the ship (in this case it was Boston because the ship was not returning to Port Canaveral) and to accommodate them while awaiting the ship.

So Delta was not stepping up as the hero, it was fulfilling it's obligation to Disney under their contract.

I've dealt with enough Cruise lines Air/Sea departments to know you roll the dice when you book their air on the embarkation date. The airline ticket is pricy but if you select it for whatever reason, it's worth the deviation fee to come in early.

That makes sense and is really interesting! Thanks! :)

A 1:40 pm arrival for a 5:00 pm sailing is very tight even assuming nothing goes wrong. Travel insurance or not, Disney has to bear responsibility for this fiasco. I would hound them until you get some measure of satisfaction.

On our first cruise our airline lost my wife's luggage and it would not get there in time before we left port. Even though it wasn't Disney's fault, they went above and beyond in helping us have a wonderful cruise. They gave us $100 on board credit to help get some items that she would need. They also gave us free laundry service so she could wash the clothes that she did have. I am sure that Disney will help compensate this family in someway for the missed time on the boat and the money it took to get to Boston.

I would think they would at least be able to say everything turned out well or they had a good time.
Odd how a member of dis for 9 yrs hasn't been back even to update a generic "it was great, can't say more".

Very true, or having returned home they could be very busy with return to regular life, work, school, routines, unpacking etc. and this isn't necessarily as urgent a priority....

This would be my guess. When I return home from vacation, the laundry has piled up, we're re-adjusting back to the normal work/school routines including kid's activities, adult's commitments, extended family, etc. I still have a scrapbook of my last cruise only half-finished because life just gets in the way and reporting vacation experience gets pushed to the back burner.

Just because someone join the DIS many years ago doesn't make them daily readers. Many only pop onto the boards for a month or so prior to a trip, or sporadically here and there during planning. I agree it would be nice to hear back, possibly the issue hasn't been brought to resolution yet. Hopefully some day the OP will return and let us know what happened.

If they accept any compensation they will not be allowed to talk about it. They will sign something stating that.

*Any* compensation?

We've gotten a total of $400 in compensation from WDW for resort problems, along with some DVC points back for a problem with the room, and haven't had to sign anything.

Those forms are for injuries.

This situation just wasn't that legally serious. It felt serious, the two (three?) days of cruising up the east coast that they missed; but it wasn't as serious as if they hadn't had ANY other US stops. And no one was injured.
