Filing a PayPal Dispute...Any Experts?

I'm heading in the direction of having to file a PayPal dispute for an item I bought. It wasn't a eBay purchase, but in the note with payment on the PayPal transaction, I wrote exactly what the seller and I had agreed on (color and material), but I received something different. I have emailed him several times, and he keeps saying he'll check and see if he has the right item, but at this point, I think I'm getting the run-around. I asked him if I can return it for a refund twice, and no response. :rolleyes1

So my question is...if I file a claim as "item not as described", does my specific selection (i.e. totally wrong color vs slightly wrong color) have any effect on the outcome of the claim? Is there a "wrong" or a "right" way to go about this so I can at least get my $ back or the right item? :confused3 That's all I really want.

Good luck. No personal experience so I can't offer any advice but I've read horror stories from people who never got their money back. :sad2:
 
I filed a dispute over a book I never received. Luckily it was only $4 because I never heard anything back.
 

You can file but nothing will happen. You can only file and get your money back if the item was never received.

That's not true. You can file that your item was significantly different than described. Paypal will put a hold on the persons funds (if there are any in his account) and investigate your claim.

I just won an auction for a $35 off $250 Dell coupon and the idiot sent me the coupon code, but it's for 35% off a computer. NOT what I bid on. He says he will refund me, but I haven't seen it yet. I'm going to file a complaint with paypal tonight if I see he read my second email (I'm on AOL) and doesn't reply.
 
You can file, but that doesn't mean Paypal will refund your money. They want you to purchase their Money Back Guarantee protection.

Unless their policy has changed drastically in the last few months, your chances of getting a refund on a misrepresented item are slim to none.

Well, a buyer has an unconditional guarantee blurb stated on their auctions if they accept paypal. Unless the buyer has opted out (and most don't because they don't even realize it's there), they will get a refund.



"When you pay with PayPal for an item covered by PayPal Buyer Protection, you may receive coverage up to $1,000 at no additional cost. To see if an item is covered by PayPal Buyer Protection, look for the following in the "seller information" section of the seller's listing.



Transactions Covered by PayPal Buyer Protection

PayPal Buyer Protection helps you in the event you do not receive your item or the item is significantly different from its description in the seller’s listing. An item is covered by PayPal Buyer Protection if it meets the following eligibility requirements.

The "Free PayPal Buyer Protection" message is displayed in the seller listing information.
You purchase your item on eBay.
You must use PayPal to pay for the item, and use the seller's email address associated with the listing. To make sure of this, use the gray Pay Now button when the eBay listing ends.
The seller's eBay listing is for a physical item. Services and intangible items are not covered.
You may only file one claim per PayPal payment. You are limited to three PayPal Buyer Protection refunds per calendar year.
Claims must be filed within 45 days of the PayPal payment.
