So I had a little fender bender today...parking ramp, I was backing out, car across the aisle was backing out (so both rear fenders were facing each other). We both started, both stopped, saw each other stop, started again and bumped. Not huge damage, but enough on both for going all of 2 mph. Anyway, we exchanged insurance info. I called my insurance explained exactly what I wrote above, to him. I agree, its partly my fault, I should have looked more, but its partly the other guys fault too.

So this evening I get a call from my insurance guy saying that the other guy called him, asked how to proceed, and told him it was all my fault, I backed into him. Now I'm kindof annoyed. First, I agree, partly my fault. No way was it all my fault because we both stopped, and then started to go again. It really annoys me that he's trying to say its all my fault. Second, I don't want the insurance guy to think I'm lying to him now, because I'm not. I told him exactly what happened. Insurance guy said not to worry, we'd just owe our deductible, no big deal, but it still bugs me. Oh, and no police report was filed, and insurance guy said even if there was they wouldn't have ticketed anyone being in a parking ramp or something. Any advice on how to not let this bug me or just advice on the situation in general?

new rule

Honest people expect to be dealt with honestly. Clearly the other driver is not honest!

That happened to DH one time. He was backing out GMC Safari(big minivan) in a parking lot at the same time as a guy in a brand new Jaguar. :sad2: Our car lost a taillight and the Jag...well, let's just say the guy was CRYING. Both insurance companies decided it was a no-fault wreck. Police were not called, although they probably should have been.I don't know what they could have done, other than make a report. We weren't too upset about it, but I'm sure the Jag had a couple thousand dollars worth of damage to the back end.

Tough one. I'm sorry you are dealing with this.

I can only offer advice for the future--when in an game of back up cat and mouse, I pull back into the spot and just sit their until the guy leaves.

I have been hit twice in my life--both times I just stopped and did not pull back into the space and each time the person continued backing up like I wasn't even there.

So when that happens, just put her in drive, pull back in and park until the other car leaves.

In your case--can you remember if you were were stopped or backing up at the point of impact? That is very very important.

Likely, your call was recorded--but if you can remember the specifics to challenge the other guy.

In the end, I don't think it is as big a deal as you think it might be. Since you claim partly your fault, you would probably be stuck with your deductible and covering the damage of your car.

I would just stick to your story to see if your insurance company can get to the bottom of this.

I had an accident like that several years ago. I paid my full deductible and had the van fixed, a couple months later the insurance companies settled and determined it was a 50/50 fault. I got half of my deductible back.

These almost always come out 50/50. Don't worry, I guarantee your insurance guy doesn't think you are lying! Us insurance agents just talk about the claims where rental cars are returned with gun shots! Now that's the kind of claim that gets talked about at the water cooler!;)
