How does Disney enforce evening magic hours? What prevents those who aren't staying at a Disney resort from just staying? This is our first time at a resort so that we can use this benefit, just wondering.
 
Nothing prevents an offsite guest from staying in a park during evening EMH - they're free to stay and shop, dine or just walk around. But they can't get on a ride because you have to scan your Magic Band to get on a ride during evening EMH.
 
Magic bands are scanned at the entrance to every ride. (Often 1 per group) If the scan does not indicate the guest is staying on-site, then that guest cannot ride.

Nothing prevents off site guests from walking around, shopping or snacking.

Also, offsite guests can enter a queue at 9:59pm for a 10pm EMH. That means lines don't instantly disappear at the beginning of EMH (but they start to flow better with no FP+ riders entering the FP+ queue.)
