Ethics question - resale that you might rescind depending on ROFR

Let's have an open honest ethical conversation.

While waiting at the tail end of Disney to deign to respond to RFOR another perfect very hard to find contract is avaialbe. I cannot afford both. Would you make an offer nowing you would rescind if somehow Disney - A. makes the 10 days and B. allows a great deal to go through. or would you sit back and wait hoping the elusive unicorn contract is still there.
BTW, another DIS member just had one passed almost identical but things have changed in the last week or so with Disney barely able to pass/fail any cotracts at all for a week.
 
Are you worried about your $108 or the $118 not passing? I know March is very different from April but it looks like the highest price taken for extended OKW is $107 for the past year. I think you have really good chance of passing especially the $118 so I wouldn’t pick up another contract while waiting. Not especially if you plan on maybe shopping for more resales later on.

Disney can be super annoying. But I would just wait.
 

I don't see how it is ever ethical to tie up someone else's asset that they are offering in good faith for fear that what you are attempting to purchase might not pass. And if it does then you'll say no thanks to the newest. It would be dragging someone one completely uninvolved into your angst over ROFR and using them to assuage your fear.
 
I always waited to see if I passed ROFR before offering to buy another BLT and I was bought back 4 times. I think it’s rude to the seller of the contract you potentially want to buy to tie it up without good faith that you actually are intending to purchase it. You keep finding perfect contracts so there will be another one it just takes a little bit of patience and if you don’t want to wait buy direct from Disney, especially OKW it will be extended already.

OP, how would you rescind the first contract if Disney didn’t exercise ROFR? I don’t recall there being a contractual right of rescission at that point in the contracts I have signed over the years, and otherwise you would need a legal basis to rescind such as fraud by the seller.
 
Put another way, you could always elect after the ROFR stage to abandon the deal but that would be a breach of contract, and you would lose your deposit. That would most likely eat up whatever savings you could achieve in the second deal.

She doesn’t want to rescind the one currently in ROFR she wants to tie up another contract that’s on the market knowing if her other passes ROFR she will opt out of it during the 10 day period on all new timeshare contracts afforded by Floridia law.
 
Didn't you also just cancel a contract past the 10 day window and eat 2K?

It's all personal choice, but I wouldn't play fast and loose with DVC offers. If I had one in ROFR, I wouldn't place another offer "just in case". I would only place an offer if I intend to purchase and see through the process. That is just me.

You have already found two of your "unicorns" it may be time to stop looking at resales sites and hear back about the one you have waiting for ROFR. Something else will come along if that one does get taken. The term "good faith offer" indicates/implies honesty or sincerity of intention and in this scenario it doesn't seem to be. Just being honest in my interpretation of "ethical" as you requested.
 
I would never make an offer in any circumstance (DVC or other) if I didn't intend to honor it.
 
Absolutely not. I’d only offer on something I plan to follow through on. Tying up the seller isn’t fair, and the spirit and intent behind the rescind law is to protect buyers who don’t understand the agreements they are entering into or making while at high-pressure/reward sales presentations.

Just imagine the sellers going through a divorce, death in the family, or financial hardship... they don’t need the extra baggage of listing and relisting because you can’t wait a few more days. (Even if they’re selling for other reasons, they don’t need non-good faith offers.)

I think you need to step away from the resale sites for a bit.
 
I think it would be ethical to make a conditional offer, for if it fails ROFR. Then everyone knows what is going on, and the seller can take that or not. Or the seller can wait.
