Error on contract, Disney requested addendum....ROFR delay?

Sooooo, we were on day 20 of ROFR and received an email from the brokers office stating Disney was requesting an addendum as there was an error on the contract. Both the sellers and I returned the signed addendum within 2 hours and the broker advised they resubmitted.

They told me it does not start ROFR over but could delay past the usual 30 days. Anyone have any experience with this, and if so, did it delay the 30 day response much?

I think a few days or weeks make no difference when you about to own something for decades. The more important question is "Did you lose the ROFR grandfathering benefit?"

There was a poster on the ROFR thread that this happened and it only looks like it added a couple days. It didn't reset the clock. Here's the information on her submittal.

On our last contract Disney requested an addendum, which both the buyer and seller promptly returned. It passed ROFR a couple days later.

I think a few days or weeks make no difference when you about to own something for decades. The more important question is "Did you lose the ROFR grandfathering benefit?"

HA......it does to me. 30 days is long enough, and that's just the start of the waiting )

And no, we did not lose our grandfathering. This is our second contract, so I already have the perks, for as long as they keep giving them that is, anyway. But I was assured this contract did not lose the grandfathering status.

They allocated the points incorrectly on the contract. The contract came with all 2015 points which were banked and all 2016 and going forward. The contract was written with the banked points in the 2016 point count. So it was a 210 point contract, they wrote 420 August 2016 points, 210 2017 points etc, when they needed to write 210 - 2015 points, 210-2016 points etc. They just added the banked 2015 points into the 2016 pt count and Disney wanted it corrected to show the correct years the points were allocated to.

We are at day 25 today, hopefully it wont add too much extra time to the waiting/decision.

I wouldn't call this "couple of days added". It's literally a full reset: 14 days to request the addendum and then another 14 days to pass.

I'm in a similar situation now. Brokers should get the 20 middle names and the 30 middle name initials of a person from the existing deed (membership), not over the phone.

Old but still relevant. 6 years down the road and people still use different variations of their names on different contracts, some brokers still don't know how to copy a name from one form to another, ROFR still resets on addendums.

We just had this happen. Our contract was initially sent on 7/28, we signed the addendum on 8/17, and it took until 9/6 to pass. Definitely seemed to add at least a week, if not two, to the process.

I didn't even get to the counting points part. I'm in the name matching phase. Are you saying it's possible to restart the ROFR a third time?

This is why I ALWAYS send a pdf copy of my primary direct contract deed to the broker/title company when I purchase a resale contract, with clear instructions to enter the name and ownership type EXACTLY as Disney entered it on the direct deed.

I did the same on my part. But they didn't do the same with the seller.
I can understand the seller's mistake. It's hard to remember what names you used a few years back, middle initials, middle names, etc.
But the broker should had asked for their deed and grab their names from there.

I don't think I'm willing to give the seller much latitude either. I have hard copies of all my paperwork for all my contracts (well, not the WHOLE pile of docs, but the important ones at least), and you can now take a photo of a doc with your phone and convert it to pdf, so even if the deed is 20 years old, you don't have an electronic copy and you don't have a scanner handy, you can still send a copy (or simply read it yourself to fill in the form and verify).

I don't hoard paperwork, but home purchase docs, DVC purchase docs, car purchase agreements, and insurance policies and info all make the short list. And investments, obviously. I guess I just think there are times when a little extra effort isn't too much to ask.

Just going to add, The broker can also verify it as well on the OCC website.

I know some do because when we sold each time and the paperwork came, it had our initials and DHs name first which was not the way I communicated to them when listing because I was the one who did it all.

Indeed, my first clue was SSR passing ROFR at $82 per point.
DVC’s practices seem to have changed somewhat in those 6 years, it seems to me that ROFR is taking a bit longer than in the past w/ or w/out the need for an addendum, & that DVC is actually taking more contracts than they used to.

I just found out that Disney requested an addendum from my seller 5 days ago. Seller hasn't returned it to the broker yet. Super frustrating when contracts submitted for ROFR after mine have passed. Also, who knows if the ROFL will change her mind and start taking my resort again.
