After 7 days the seller can close it even if the other party didn't respond.

My experience with eBay is that you can close a case after a certain time. Wether or not the other party responds. They do not expect you to keep a case open forever waiting on the other person. Most of my situations have been unpaid item claims but there were a couple of times that I had a mutually cancelled transaction. Either way if you do not get paid from a buyer you will get a credit for the final value fee. Good luck.

They must have changed it because the big thing used to be that if the buyer didn't respond and the time ran out you didn't get the credit...
