Ebay dilema...need your opinions please!

Hi all! I have had problems with an auction and I want some honest opinions, so where do I turn but my DIS family.

On June 7th I won an auction for some old scrapbook magazines. I paid as soon as the auction ended via Paypal. She sent me an email saying thanks and she would mail them the next day.

On June 16th I sent her an email to let her know I hadn't received them. She responded by saying stuff had come up and she put them in the mail on the 15th with a few extra magazines. By the way.....I was ok with this because I know stuff happens.

On June 28th I sent her another email because I had yet to receive tham. NO response! They showed up yesterday, June 30th, with a postmark of June 24th. That is 23 days after the auction ended and I paid for Parcel post...not media.

The magazines are not the correct dates as stated in the auction. Two of them have the top 1/3 of the magazine cover ripped off. In her pics she hid this by overlapping. No mention of this in the auction. She did send one extra magazine, but at this point it seems like too little too late.

WHAT WOULD YOU ALL DO????????

I would email her with everything you have said here and see what her response is. What would you like her to do to resolve this for you? Put that in the email also. Then.....wait to see if you hear from her.
If you do not get the resolution that you want you can report the seller to ebay for misrepresenting the auction. Here is a link to help with the info: http://pages.ebay.com/help/confidence/isgw-fraud-protection.html . But they do require that you get in touch with the seller by phone first to file this. Keep all email pertaining to the auction to send to ebay if they request it.
Unfortuntely on ebay at some point you do hit a bump!! I've hit a couple with buyers and sellers....I guess it is part of the risk, but very annoying and upsetting when it happens. Hopefully you will get the response you want from your seller and resolve this.

I did send her an email last night tolet her know I was disappointed and all the history of this transaction. She has never even bothered to leave me feedback. I have a huge problem with that since I completed my end of the agreement.

I have debated leaving her negative feedback or even asking for a partial refund.
 
I made an ebay purchase, never received the item, though the seller claims to have mailed it. What would you do as far as feedback? Just post "neutral" and say you "never received it, may be lost in the mail"? I paid, and therefore did my part. But I don't want to leave negative feedback since they did respond and claim to have mailed it, but how can I leave positive feedback when I never got the item? Any suggestions???

Here is Paypal's Buyer Complaint Process.......

When a claim is filed, PayPal determines which protection coverage applies and processes the claim accordingly.

PayPal's Buyer Complaint Process helps protect PayPal members when a merchant does not deliver goods as promised. PayPal's Buyer Complaint Policy applies only to tangible, physical goods which can be shipped. It does not apply to intangibles, services, quasi-cash or non-physical goods.

PayPal Buyer Protection is an extension of PayPal's Buyer Complaint Process. Under PayPal Buyer Protection, when you use PayPal to pay for a qualified listing on ebay.com, ebay.co.uk, ebay.ca, or ebay.de you are eligible for up to of coverage at no additional cost. PayPal Buyer Protection covers non-delivery of items and items that are significantly not as described.

You can also go through Square Trade (a dispute resolution service in Ebay Services) - There is no cost unless either the buyer or seller requests a professional mediator. Then, the party who requests the mediator has to pay for it.

amcnj - I wouldn't leave feedback yet, I'd wait until the 89th day after the auction and see if you have either your merchandise or money by that time. On the 89th day, you can pretty much leave negitive feedback without receiving retaliatory feedback from the seller.

Sounds like this person just 't seem to care....so unfortunately you may not get the positive that you deserve. Honestly, you would have been justified asking her for a full refund as she did not ship the items that you bid for in the auction. You may still want to attempt to file a complaint through the link that I gave you. She will be notified that you have filed the complaint and that might be just enough to get her to answer your emails and resolve this for you. I would hold off on leaving the negative until the very end....I think it is now 90 days after close of auction...you don't want her to neg you back in revenge....you certainly don't deserve that!
 
amcnj - I forgot to add that you should ask your seller for a tracking number. If you paid via Paypal & they can't produce a tracking number, you most certainly will get your money back.
