E-Bay Confusion-Please Help

Here is the problem. What can or should we do?

My daughter bought a Cow Parade porcelain figurine.
She paid with Pay Pal.
She paid $10 for the cow and $10 shipping.
It was sent Priority Mail USPS.

The ear on the figurine was chipped when we unpacked it and we immediately sent the seller an E-Mail.

It appears that the piece was damaged prior to shipping as the cow was packed inside a plastic bag, in the original styrafoam packing, inside the original box which was packed inside a shipping box. The chipped piece should have been in the plastic bag if the item had been damaged in shipping, but was not. The inside box was undamaged.
Also, in the photograph of the item on E-Bay, the cow was positioned in such a way that the damaged ear was not visible.

The seller replied that the item was insured and to take it up with the post office.

DD prematurely leaves a neutral feedback.
The seller then leaves her a negative feedback and remarks that he does not control the post office.

So today I take the cow to the post office and the person there is filling in for someone, doesn't know how to handle it, and her computer is down.

Then I go to post office #2 and the lady there doesn't know how to handle it either. Apparently the postage label was done on line. I am to call her back tomorrow to find out what to do next.

Anyway, does anyone know how this insurance works?
Even if we are able to collect on the insurance, are we out the shipping?
Do we have any recourse with Pay Pal?

I really hate being taken advantage of, but I really really hate my kids being ripped off!
 
We have had to collect insurance two times and both times it went smoothly, but it takes a long time. One was a remote control airplane DH ordered from Hasbro that got lost, we got $100.00 that DH had paid and the second was an item I sold on EBay that got lost. They need proof of price paid I believe, it's been over a year since we have had to do it, but it does work. Good luck finding a knowledgable postal worker (try a larger PO if you went to a smaller one).
 
I, personally, would try to do a Paypal chargeback since the item was apparently damaged before shipping.
 
I think you'll have to go via the Post Office insurance, since usually the idea has to be a lot different than as described. Paypal seldom gets into condition issues. But hey, it's worth a shot, since the post office won't be too happy to replace something that was prob already broken.

If she paid with a credit card through Paypal, she could attempt a chargeback through them. But Paypal generally won't give a refund if the seller can provide proof of delivery. Even if they delivered (literally) a box of trash - I know someone who had that happen. She really should have given the seller a chance to fix the problem before leaving feedback, but I guess she knows that now!

Don't count on it. I sold a Playstation system that WORKED when it left. A week after the guy gets it he put a complaint in with Paypal. (he paid with a credit card). They gave him his money back! I still cant believe it! :sad2:

Did Paypal authorize the refund, or did his credit card do it? I keep hearing that Paypal won't intervene at *all* in cases where the item is not as described. :confused3
 
You can do a chargeback with a cc, but I thought that (and I guess I could go look it up, if I really wanted to know LOL) we agreed not to do that in the Paypal agreement? Because I know it costs Paypal money.
 
Your DD can post a response to the negative on her feedback giving the correct info. From what I understand the seller needs to start the insurance process with the PO since they paid for it and I don't remember being able to get insurance online when I last shipped using the PO. You had to go in & get the receipt & pay inside the PO. Honestly, I doubt that it will be paid out by the PO since the box should be in good shape from what you say & the item was damaged before shipping. :(
 
Your daughter can in fact go through paypal and if the seller cannot provide delivery confirmation she will get her total payment refunded. I have had this happen to me (not in my favor). Unfortunately I shipped an item without delivery confirmation so once the buyer received the item (I'm assuming)they went through paypal and claimed that they never received it and paypal gave them their money back shipping and all because I didn't get delivery confirmation. Needless to say I always use delivery confirmation now. But bottom line is do you remember whether the item had delivery confirmation or not? If not paypal will give your daughter her money back. If it did have delivery confirmation then she can still launch a complaint stating that the item was misrepresented.

If your DD paid w/ a credit card, she could put it in dispute with the credit card company. I had an "item not as described" purchase on ebay. All it took was one phone call to my cc company (Chase Visa).
 
Since it was printed online I would assume that the person had DC on the package. Of course, if she has a personal account with paypal it wont matter if she has DC or not. It is right in the terms of service for paypal's personal accounts that the sellers are not protected. That's a big way for someone to scam you. I guess that is the only good thing about ebay's change that you need to have a business account to sell now. I took a risk having a personal account knowing this could happen.
