DYI - Add another member on your own??

Has anyone added an additional member to their contract on their own? I would like to add another member. I have contacted MS for the paperwork needed. I would really like to avoid the costs of Disney and/or a closing agent handling the paperwork. All advise and tips appreciated.

First - I have not done this. I am not a lawyer. However, I would think it would be relatively simple. It may not be cost effective to do so.

You'll need to submit the plan to add another name to the deed to DVC to obtain their waiver of their Right of First Refusal. If this is just adding a relative to the deed, then I would expect that they would not have an issue. They may have a charge to do the review / issue the ROFR document.

Then you need to type up the new deed in the exactly correct format, including they type of ownership, and get it signed / notarized.

Then you'll need to submit both the ROFR and the new deed to the county clerk for recording and pay the filing fee.

Then you'll need to submit a certified copy of the recorded deed to DVC so they can adjust their records, along with any required fee.

I would consider the costs and time involved versus the cost of just having a title company (e.g. Magic Vacation Title) do it for you. It may not be worth the cost of running around searching down the contacts and forms when a title company knows what to do.
 
I have done so, actually added my daughter to four 25 pt AKV contracts. Contact Member admin or email MS and ask the forward the info. They send you the instructions and forms you need. The process is that you need to submit a request to change the owners to DVC who will then give you a ROFR automatically as long as at least one of the previous owners will still be on the deed. Once you have the ROFR, you then need a deed. A quit claim deed will work but some say it may interrupt the chain for a title insurance if you later sell. One can get a FL quit claim deed template fairly easily, I found a word file online when I did it. You then submit the deed with all signatures notarized and TWO witnesses. The notary can be one witness but they have to sign separately as a witness in addition to notarizing the document. You then send the ROFR, deed and payment to Orange County (assuming WDW). We were able to get the 4 deeds down to one page and all ROFR for the 4 on one document of 2 pages so right around $50 for the change. Once recorded, you complete another form and send a copy of the recorded deed to DVC to change the ownership. In the past they've had fees for this but I don't think they are charging anything right now.

Email me directly and I'll send you the template deed I found at the time which meets the FL law requirements for deeds and recording. You'll have to do it yourself. There are several online companies that will do it cheaper including one that will likely do it for around $100 if I understood some other chatter correctly.
 
When I contacted DVC they wanted $300 to add someone to the deed. I had my BIL (attorney) do it for me and it cost me maybe about $30 for recording fees. He said that most law offices would do it for about $125-$175. He thought DVC was pretty steep for what is involved. Also, DVC will send you instructions for all the documents that are needed. Good luck!

Not only is it $300 to mod the deed, but that is per contract! Our points are actually made up of 3 contracts.... $900!:scared1::scared1::scared1:

This is why we haven't changed anything!

Even $200 is expensive but far better than $900!

Sure, not a problem. Just remember if you only change part of them you create 2 master contracts that are not linked.
 
I believe the contracts must be paid off in full not financed by Disney, is that correct?

I may actually look into this myself as well...

You either need to have no pending mortgage or you'll need the written permission of the mortgage people and I'd assume a new mortgage.

My parents were considering putting us on their deed for estate planning reasons and their attorney said it would be $400 ($300 for 1 contract and $100 for the other). This attorney was doing all of their updated estate planning and said those were Disney fees not his.

That didn't sound right to me. It seems like you should be able to have an outside attorney do this and only pay the filing/recording fees. I pay a monthly premium for access to legal services through work and real estate transactions are free for me (and others if the transaction benefits me in some way) through a network attorney. That would reduce the cost to the filing cost of $30 or so.

If you can do this, how does one do so? Do you just provide a copy of the title to the attorney and ask they assist with change or is their certain information you have to get from DVC first to provide to the attorney doing the transaction.

As I've noted, you can easily do DVC yourself. If not, This company will apparently do it all for under $100. Others will start at around $250 or so and some of them will require you get the ROFR or charge an extra fee. You just need to get your estate attorney to let you know how the deed needs to be listed.

We've just gotten very conflicting reports on this, including an estate attorney who apparently didn't have a clue. Were told by an estate attorney that even if they prepared everything Disney would charge $400.

Disney has no inherent charges if you do it yourself or someone else does it for you. At one time they had a transfer fee that was $100 and went to $200 for a short time then vanished. I'd expect it to come back at some point.
 
When you add members (in our case, our parents are adding us for estate planning purposes), once it's complete and on file with DVC, will they send us member cards automatically?
