DVC policy - Can't rent points?

I was just told by member services that "it is not point rental is not DVC policy"

They made it sound like it was against the rules?

Can someone clarify
 
Not sure I understand your comment, but the POS clearly states we are allowed to rent our points.
 
My point was they made it sound like I was doing something wrong.
 

MS personnel once in a while make stupid comments (some swear, however, it is no more often than every 2 minutes). Renting is allowed regardless of what someone at MS says. What is not allowed erssentially is to just be in the business of renting and thus they have a rule that says if you make more than 20 resefvations in a use year you presumed to be evil but under twenty you are still a saintly DVC Member..
 
The only thing "against the rules" is a non member calling DVC Member Services. They will only speak to the DVC Member - are you the member, or are you the person who is renting points from a member?

Exactly. What the Public Offering Statement does not allow is commercial renting. And it does not allow for compensation for transfer either. So if you decide to transfer points to another member, don't discuss payment while on the phone with MS.

Also, the POS requires members to use a contract when they rent out a reservation. And it also requires them to notify MS that they rented the reservation.
 
Well if commercial renting is not allowed how do some of the websites that rent points out as a business do it? I just put in a request with a commercial renter.:laughing:
 
Daddio's service (dvcrequest.com) is not renting points as an owner, but connecting owners who want to rent their points with those who want to rent and handling parts of the transactions. His service (in my opinion) is more of a broker for the transaction, which is different than how it was in the past when he was an associate on owners' accounts. The owner now has to make the reservation from what I understand so unless an individual owner is renting enough to hit the commercial threshold, his service wouldn't be breaking the commercial renting threshold.

(And of course David might explain it differently - that's just my current interpretation of it.)

For other similar sites out there - if there are any - I couldn't offer any opinion.
 
Ok, so if you post the least little thing around here that is against Disney's policies it get censored, uh removed, and you get warned, but they have a sponsor who is renting out points commercially, which is against Disney's rules and that is ok? I mean, don't get me wrong, I think it is great that you can use a company to rent points from, :thumbsup2I may do that in May of next year, from this sponsor. But, ewwww if I were to post tips on how to get around some of Disney's rules I will get a scolding!:rotfl: This seems like a double standard here for the DIS.:confused3 Maybe I am missing something.

Oh, ok. That makes a little sense to me. I am hoping to get in on a last minute special hopefully for SSR next month for my stay in May.
That will defantiley beat CBR.

I am a member, I rented points to add on one night. The reservations are linked and they asked about that. I said that i rented the points for one night.

Her comment was something like don't let anyone know, its not allowed.

It's highly likely I have things all goobered up here, but I thought I remembered a technicality that points can not be rented. Instead, you have rent the reservation.
Could that be the thought process of MS?

I think we see too many anecdotal accounts of members being told stuff like this for it to be the accidental misstatements of uninformed CMs. I'm sure MS management has let the CMs know that DVC wants to discourage renting whenever they can, because rentals are direct competition with inventory that DVC owns.

We've even seen a number of situations where CMs have actually told owners that renting points was "illegal," which is laughable.

Technically correct. The POS says you cannot "transfer" points in exchange for compensation. That is mainly designed to protect DVD's A. Despite that members always think in terms of their points being the key and the only thing of value, the POS actually declares that points themselves have no extrinsic value. Instead, they are symbols that represent what you do have of value -- the percentage ownership real estate interest in the resort that is then represented by points. Thus, transfering points for dollars is contrary to that concept and by saying you cannot do so, DVD avoids any issue of ever being involved in any disputes between members over transfers made for dollars if anything goes wrong with the transfer.

You can, of course, rent to another by reserving the room time with your own points; that is not a "transfer" of points. Also, you can probably avoid any issue of being challenged on an actual transfer of points by simply phrasing the contract to have the payment made to you in exchange for your transfering your right to reserve the amount of time in your home resort that is represented by a certain number of points and then as part of that contract agree for no additonal payment to transfer the applicable number of points.

If you rented a single night reservation from another member, you don't own that night. Technically, since the points used for the one night don't belong to you, you cannot ask MS about that reservation. Only the owner can ask about it.

But if you transferred points, they do belong to you.

When referring to my business model, I always recommend contacting ones attorney if they are in doubt as to the intracacies of any POS and its contents/bylaws.
