Do you pay 2013 annual fees if only part of the points are available?

I am looking at one that only has 3/4 of the 2013 points left. Does the buyer still pay the 2013 fees?

You pay current year MF for the 2013 points you get. ie if you get 75 points for 2013 out of 100 point contract, you pay current year MF on 75 points.

I stand corrected- not written in stone. MF are negotiable.

Can any of the pros out there advise how that may or may not effect ROFR?

The 2013 dues were paid in January, but the owner will probably want to be reimbursed for the points he/she did not use. You won't want to pay the dues on all the points, just on the unused points. Unless you can get the owner to not ask you to reimburse them.

Please stop giving answers so matter of factly unless you are sure of the answers. I am working on my 3rd contract right now. All 3 had, at least, the current years points and I have only paid MF once.

As Doug said it is all negotiable. I also find that many people are not concerned with getting the MF's reimbursed because the money is already gone.

I am not trying to be a jerk, many people will read things posted in here and take them as fact, many times they are not. Just be careful what you post, people are relying on you when they are new.

In general for a resale, who pays what is very much part of the negotiation.

Like you, I've gone through multiple DVC resales and never paid the current year's Maintenance Fee (MF).

There are some resellers who might discourage you from negotiating the MF but if they do so, they are not working in your best interest, they are working in the seller's best interest. My suggestion would be to buy using another broker.

This is blatantly untrue. Everything in a resale negotiation is negotiable. I purchased a BLT contract with points banked from the previous year and paid absolutely no MFs as part of the sale. It's a numbers game for buyers and sellers. As a buyer, know how much you want to spend total and then you can often feel out the seller on which numbers are more important to them: per point price or MF/closing. EVERYTHING IS NEGOTIABLE.

So if you are buying a DEC UY contract and you are reimbursing maintenance fees, 11/12 of what you are reimbursing is the maintenance fees on the 2012 points and not the 2013 points as many are led to believe.

I could never know or say difinitively, but my personal opinion is that ROFR is all about inventory levels and waitlists, and has very little to do with how a contract is written. But I know nothing and this is purely speculation on my part.

We had a similar situation buying an Oct UY resale contract in February of 2010. The contract had all 2009 points and all 2010 points. We were asked to pay just one year of MFs even though we were getting two years of points. We were not asked to pay 25% of the 2009 MFs, and of course we could have negotiated paying the 2010 MFs but chose not to.
