My understanding from a few designers who have done Disney related kits is that Disney has a problem if you try to SELL their copywritten items but not if you make a look alike and give it away. I dont know of any designer who has actually been contacted by Disney and you know they know the kits are out there because the finally got on board and made their own.
 
I just got this comment on my blog...

I know there are a ton of digi designers who use Disney images... what is YOUR opinion?
My opinion is if you are making the images yourself and not selling them you're okay. But if you are scanning copywritten images and using them to make kits even to just give away then it's pirating. (IMO, not the same as scanning and using for personal use)
Clip art is more subjective I think but it's a fine line.
Whichever category you fall into, the word Disney splashed all over your site is eventually going to draw attention that you may not want. Whether what you're doing is right or wrong they are 'bigger' then you kwim? Just my 2 cents.
 
I had heard that the company first has to ASK you to stop. If you do not comply then they can take you to court.

I'm not trying to do something illegal. I just want to offer something people want to download from my blog.

I certainly understand if companies want to be protected from people using their images in a negative way.
 
well I am not scanning...just using clipart online.

I know it is a very thin line. I guess I'll offer my add on tomorrow and be done with it because I really don't want to do something wrong.

I just see SO much of it.
 

Go to the DISign part of the DISboards. There are people there who have been contacted by Disney legal. I cannot remember their name off the top of my head. They can tell you best. PM me if you want me to search my files in an effort to get you the best person to contact. But you can go to there area and ask them as I know about 8 months ago there was a huge discussion about this very topic.

However, for those who have been to ebay and seen the person that sells kit after kit full of Disney stuff that is who I think they should be after not the peson putting a freebie on a blog. That is just my opinion.

I do know for a fact that you would recieve a cease and assist letter first before Disney would do anything to you.
 
I would think they'd have to ask you first, too. The only people I know that have been shut down scanned copyrighted paper scrapbooking supplies and were selling them as digital products on a very public site (eBay). My thought is, as long as it is a freebie, it seems like not such a big deal. There are tons of sites out there with Disney clip art and Disney fonts and they haven't been shut down. I'm thinking you're OK, but I'm no lawyer!

BTW, I have Disney written all over my blog, too. I think Disney has a lot of better things to do than surf the 'net for little blogs like yours and mine. They have bigger fish to fry. I made a couple of Disney freebies, too (with fonts, not clipart, but seems the same to me). I have plans to make more. If Disney asked me to stop, I would, but I really don't think I'm infringing on anything.

off topic....I think your guys idea of a stroller swap is great. I cannot tell you how many people I run into upset over the new low price of a double stroller at Disney and how many I have given directions to the Target so they can spend 20 and have a stroller for the rest of there trip. Your stroller swap is such a great idea!!!
 
Before I became a designer I would have agreed 100% with the Sconnell about naming files so people know who made them.

Then I became a designer and got really lazy! I don't mind if someone doesn't credit me in a layout. Of course it is wonderful when they send people my way! And I like seeing my name as much as the next person :blush: but don't sweat it if you don't remember.

It's great you want to credit the person, but you aren't claiming the work as your own so do like DisneyCruiser2008 says and just put ????.

From my viewpoint, though, how do I know which designers think it's ok not to credit them, and which designers require credit? To know who's who, I'd have to remember who designed what, and so I'm still in the same boat! :D If the files aren't named with the designer and/or kit, I have to rename them because of how I organize everything (on one hard drive I keep everything by designer, then kit. On another hard drive, I move papers/elements into folders that describe them, so I can easily find stitching, for example, when I want it.)

BTW, I just used one of your elements in a LO I just finished, and I credited you. :P
 
It common courtesy to credit the designers that you use. You should make a point to note your credits as you create pages, so that you don't find yourself in a quandry down the line when trying to do credits.

I have read these and that's where I came on the idea that if your blog/site screams Disney it might not be a good idea. Someone said in one of those threads that they have people who's job it is to specifically do searches with keywords. I don't think if you're just a fan of Disney stuff or even giving it away you'll find much trouble.
Personally I don't have a problem with any of it other then handing out copyrighted stuff (again, no issues w/personal use whatsoever) which is just like taking a digi designers stuff or stock photos and distributing it to other people to use. If one is wrong then so is the other but that's me, what other people do is their business. I'm betting the ebay chick will get busted eventually.
All of this longwindedness to say, I hope nobody thinks I was trying to argue or come down on anyone, not at all, just giving my point of view. Disney would make a fortune if they'd sell digi cd's that everyone could use.

Yep, they would! If they would just make a CD with the same stuff they sell in paper kits, they would make a fortune! They could make such cute stuff!! Until they do, we have to figure out how to make cute Disney pages without them...
