Hey all...

I have a question that I need to ask someone and I don't know where to turn.

Without going into detail, I had a suit threatened against me. The paper work was even filed and I was sent a certified letter to this point.

Today I received another letter from the law firm with paperwork for a Voluntary Order of Nonsuit from the plaintiff. It says:

Comes the Planitiff, by counsel, and requests that this Court dismiss the above matter.

This is a certified letter of a copy of this order and has been signed and dated.

Now my question (well verification really). Does this mean the suit has been dropped? That is what I am fining online, but if anyone has any experience then I would be very happy to hear it.

Personally before you start getting hundreds of answers here if I were You I would find a local attorney that will give a free consultation & have him/her read over everything you have & advise you if you need to do anything else.

OP, i am not an attorney, but a former legal secretary, and based upon the line you quote in your post, the person who filed the suit has had their attorney file a motion to dismiss it. However, when you say it was signed and dated, do mean it was signed and dated by a judge? A Motion To Dismiss with the accompanying Judge's Order granting same would need to be signed and dated by a Judge, then filed with the court, for the matter to be formally dismissed. I would call the local District/Circuit Court (whichever the suit was filed in) and make sure the Motion To Dimiss and Order is on file. Also, I would likely show it to an attorney, just for my own peace of mind.

I do have a call in to a local attorney who was helping me out originally. I am waiting for a return call.

I have verified that the motion has been filed at the courthouse.

I just wanted some "personal" verification from anyone who may had received something like this in the past. It's like I don't trust what I am hearing and reading.

I don't blame you but I'm sure the atty you have in your corner can get a written copy of the dismissal for you....not to air dirty laundry DH went through something similar (sadly with a family member vs him) and when it was dismissed we had an atty get a copy of it...just in case for the future you know? Don't worry it will work out :hug:
 
I am an attorney, but not in your state. In my state the plaintiff can drop the case/withdraw the case at anytime, but the key point is whether this is done "with prejudice" or "without prejudice". With prejudice means they cannot bring a suit against the same defendant for the same action again. Without prejudice means they can re-bring the suit if the statute of limitations has not expired. Each of these might be done for various reasons.

I do not know if your state has something similar. I would check with your local attorney whether they can recommence the suit after this one is dismissed.
