Has anyone gotten this e-mail notice from Photobucket???? :confused3
To my knowledge I didn't have any posted on my web site ...curious if this was a bulk mailing??

""The copyright owner, DISNEY, has requested that all copyrighted images of
Mickey, Minnie, Tigger, Winnie the Pooh, Desperate Housewives, and Greys
Anatomy be removed from Photobucket.com. According to DMCA (Digital Millennium
Copyright Act) regulations, we must remove these images because the original
copyright is owned by this company. You're not being held liable and they are
not seeking any legal action except the removal of the images. We have already
removed these images for you and no further action need be taken by you.

If you would like these images reinstated, you may fill out the following
Counter Notice and we will repost the images. But we must warn you, if we
reinstate these images, Disney will take legal action against you.""

I just checked my Photo Bucket and my pictures are removed. I did not get an e mail. Thanks for posting this. My only question is how are we going to post pictures on the DIS now? I am going to have to find a program for this I guess. ;)

wltdsnyfan...

There is a photo site here on the DIS.
I don't use it..
I just find it more difficult to use, but, then again I'm a "keep it simple stupid" kind of person. ;)

I will have to check tht one out. Hope it is as easy as photobucket.
thanks :sunny:

Since you're a Silver level sponsor, you are entitled to unlimited photo uploads:

Do keep in mind that it is possible that eventually Pete will get the same notice from Disney (if he hasn't already). Anytime Disney is made aware, through official channels, that their trade marks are being displayed without license, they're obligated to take action to preclude that, or they face losing the right to protect their trade marks in ANY context.

Wow, as soon as I saw your post, I ran over to Photobucket and double-checked. So far, they're still there-2 pictures of Mickey, 1 of Minnie. The Tigger pictures I have don't count since they're my cat Tigger, not Disney. But if the pictures I have of Mickey and Minnie suddenly disappear, now I'll know why. Goofy, Chip'n'Dale, Peter Pan, the others OK? If so, I wonder why-where's the "line" drawn?

Legally, the line is drawn with respect to reasonable expectation of knowledge. If Disney can reasonably be expected to know that their rights are being violated, then they are obligated to take action.

Don't know, Simba's Mom ... :confused3

Im wondering about those creative DISers who, on this board, have those GREAT applicays that do personal T-shirts for thier vacations??
What a bummer :sad2:

I didn't get an e-mail and my pics are all still there. I was wondering if they were only targeting pictures that might be watermarked by Disney (like photopass pictures perhaps) or that have Disney art work? :scratchin

Mine are still there...which pictures are considered "illegal"? Ones that are clearly Disney property? Or anything with a trademarked character in them?

Does Photobucket sell prints of photos?

They deleted everything. I had 3 folders; Disneyworld 2005, Disneyworld 2006 & International emblem (pics of dh's truck)

Oh, my gosh! They deleted EVERYTHING?! I'd love to hear their rationale behind that one! Please keep us posted. DS was lucky enough to get a summer program at DL where he performed every day at Town Square, Parades, in front of the castle. I took a bunch of pictures when I went out to see him, and if they deleted those, I would NOT be happy!

It could be that there are some specific trade marks that have been violated by SOME photobucket users. All photobucket had to do was go through all the Disney-related images and delete the ones that actually were trade marks. However, that's a very time-consuming and labor intensive operation. Given how little members pay for photobucket (uh, nothin'), and given that members agree that photobucket can delete whatever they want whenever they want, it isn't surprising that they'd take the easy way out, and just delete everything that could possibly be a violation.

So far, all my vacation pics and clip art is still there. The clip art in my siggy is uploaded to Photobucket---so I guess when that is gone, I'll know they've deleted everything. What shame disney feels threatened by this ?
I guess I could see the clip art (but still ?)---- it's the vacation pics that are being deleted that confuse me ?

It's not that Disney "feels threatened". Judicial actions have held that if a company has reason to know that their protected assets are being used without license in a specific context, and that company takes no action to assert that protection on that context, the company LOSES the right to protect those assets in ANY CONTEXT.

Yes they do, if your album is public anyone can go to your album and BUY mugs/prints/shirts/etc... It is not just a image hosting site.

I think that is the problem, Only disney can decide whoe is allowed to sell merchandise of their copyrighted characters and trademarks.

Photobucket is protecting themselves from Lawsuits, the same way ITUNES would not knowingly give away the theme from "its a small world".

:confused3
Ok but what does a Ford truck have to do with Disney. This was a seperate folder that was deleted.
