We are currently in agreement for a resale DVC contract for BWV. Before we send back the contracts, my DH wants to see the actual Disney timeshare agreement. Does anyone know where I can get a look at this? I asked my Realtor to send me a copy, but it hasn't gotten to us yet (we've been waiting for it all week. slow mail, i guess).

Is there a web-based copy of it somewhere? I don't want to wait any longer to send back the contracts, but DH won't allow me till he sees the agreement. Grrr!

AFAIK, there are no contracts online anywhere unless someone has scanned one in somewhere, but I've never heard of one being available online.

Just ask them to scan a copy of the Public Offering Statement and e-mail it to you.

Wouldn't these be scanned into the record at the Orange County Comptroller's office just like all of the deeds and notices? I'm not sure how you would search for it, but our BWV deeds had specific information about the offering. Here are some excerpts from our deeds that discuss the public records:

"...the Disney Vacation Club at Disney’s BoardWalk Villas, a leasehold condominium (The “Condominium”), according to the Declaration of Condominium thereof as recorded in Official Records Book 5101, Page 147, Public Records of Orange County, Florida, and all amendments thereto (the “Declaration”); subject to that certain Ground Lease by and between Disney Vacation Development, Inc., a Florida corporation (“DVD”) and Walt Disney World Co., a Florida corporation, dated April 1, 1994, and any amendments thereto, a short form of which is recorded in the Public Records of Orange County, Florida, and any amendments thereto (the “Ground Lease”); and subject to that certain Master Declaration of Covenants, Conditions and Restrictions recorded in the Public Records of Orange County, Florida, and all amendments thereto, and subject to the easements and restrictions of record."

and a little later in the document

"SUBJECT to the specific use restrictions set forth in the Disney Vacation Club Membership Agreement for Disney’s BoardWalk Villas (the “Membership Agreement”), recorded in the Public Records of Orange County, Florida, as the same may be amended from time to time, a copy of which is attached to the Declaration, and set forth in that certain DVC Resort Agreement for the Disney’s Boardwalk Villas (the “Resort Agreement”), recorded in the Public Records of Orange County, Florida, as the same may be amended from time to time, a copy of which is attached to the Declaration; and subject to the provisions of the Master Cotenancy Agreement, a copy of which is recorded in the Public Records of Orange County, Florida. By Grantee’s acceptance of this conveyance, Grantee agrees to abide by the terms, conditions and restrictions imposed upon Grantee by the Membership Agreement, the Resort Agreement and by the Master Cotenancy Agreement."

Maybe something in there can help you find the records at the OCC website...

The declaration of condominium declares the legal operation of the timeshare and the rights, privileges of the developer and the buyer. And yes you can look the declarations up online.

The POS (the public offering statement) explains what the prospective buyer can expect in purchasing the timeshare. Much of what is in the POS is incorporated in the master declaration of condominium. As far as I know the POSes are published items only.

I believe this link will show the Master Declaration for BWV.
