It was the board who stated that and they are the ones who make and enforce the rules,

But yes, they could enforce it for OKW because that restriction wasn’t tied to commercial in anyway.

It is a limitation to renting included from the start. I haven’t had time to check other POS documents yet to see if it is there or if it was removed from the other resorts.
RIv has no restriction

Reading the whole paragraph again , RIV POS has strong protections for, at a minimum, renting points on your own. The line about the "terms and conditions that they may establish" shoots down the " if you get paid for a rental its commercial" argument.

There certainly is a lot of different language in the contracts that discuss things that owners have to make decisions.

That, plus the official policy in place that defines things, updated T and C, and HRR add to what owners have to use.

You also have FL 718 and FL 721 that guides things for DVC in terms of what moves would be considered legal.

I am pretty confident that DVC knows what limits they can push and that if they really believe they can do certain things under the umbrellas of “pattern of rentals….” to be commercial enterprise, purpose or practice, they will add it to documents so it less ambiguous for owners.

I mean, there is some reason they have chosen to update the offical policy to date…and it very well could be..assuming it could still happen…they have some legal hurdles to cross before they can.

We shall see what further clarification I might be able to get from them.
 
That is strange that Vero and Hilton Head don’t have it too. Skipped it for those two, added it back in for Boardwalk and then dropped it again.

It is in Vero and Hilton Head.....it appears that they removed that as a limitation from BCV and forward. I have checked all the DVC Membership Agreements for each resort (which is where that limiation is included for the resorts that have it).
 
Why would Disney release inventory back to DVC? Even if the rooms haven't rented yet, I can't see Disney being that altruistic. Why wouldn't they just offer discounts on the rooms?
Same reason why a member wouldn't want to rent out their points for super cheap. If they can bank them or use them on a different room later in the year and rent them out for a better profit, etc.

I'm not arguing, just curious. I don't know if DVC is enforcing anything, just trying to understand what might be going on.

When parks and hotels releases discounts they don’t typically only release them on DVC rooms, but all deluxe level.

DVC doesn’t have any control over discounts either so it’s not like they can add them on their own.

It could also be related to owners canceling things they didn’t yet rent because they were notified of being over the limit?

Far enough out not to go into holding…

No way to really know.

Given that we saw entire months (I think I can mention this now that it's long gone?) dropped at one or more Crescent Lake Resorts for certain room types, I would think it had to be DVC, or the big commercial renters are even bigger than I realized... but if it because DVC didn't sell them, that doesn't bode super well for the general WDW hotel/resort occupancy.
I have checked this before, and if I recall correctly it is only BWV and OKW that has this restriction.
Sort of a bummer for this BCV and later resorts owner, but BWV is where enforcement is needed most of all.
