I definitely should be entitled to payment here, since the listing, the contract (signed in May), and all communications with Fidelity mentioned the points were being included. Holding out hope that the broker / seller compensates me for this somehow...

Actually, good news on this one. My Fidelity contract included a specific line that you will be reimbursed at 25$pp for missing points. I'd check your contract, the first one that you signed for ROFR.



It will be a title claim and go through the title company. I'd make sure your title company is already aware in case the funds have not been fully disbursed they can hold some back.

I sent Member Admin an email asking for the new contract (with all the details) to be added to our existing membership. I got a reply the next morning (Sat) with apologies saying it has been done but my points needed to be added by Member Services and should be within a day or 2. Points were added and showing on my dashboard Monday morning.

How long after closing did you do that?

We closed Fri, 6/14. The deed was recorded Mon, 6/17, somewhere around 7am. I emailed Member Admin on Fri, 6/28, using the email in the contact us menu. Gave them contract #, deed # and deed recording date & time. They replied Sat.

They said ordering the deed from Fidelity. Which makes no sense to me since I see people getting docs for both CA and FL resale next day , 2 days later.

No luck yet. I have spoken with the title company as well and they basically said to give Fidelity a chance to resolve it and that she could escalate to a higher up at Fidelity too.

Fidelity is saying that the sellers did not use any of the points (well, duh, they expired!) and is basically telling me that I should leave it there because we got the sellers to accept a low offer.

I told them that the listing and contract mentioned the points were included, that either the sellers or Fidelity misrepresented the contract and I expect to be covered by the clause setting a rental price of $25 per missing point. Waiting to hear back from them on that.
