ok, if a review is ordered, from today, and an adjustment is granted can they go back prior years or would it be from the time the review was requested only?

When we have a review (every 3 years - NC) our adjustments aren't retroactive. I'm not sure if things are the same across the country.

The letter I receive in the mail states what happened during the court hearing, the income information both of us are required to supply, the adjusted amount and the date the new amount goes into effect.


Oh, if there are any arrears, that is noted as well as the amount of support that covers them.

Like I said, I have a NC case, things may be different in Florida

My understanding of it is (and take this with a grain of salt because I neither pay child support nor get child support), is that a review is done to basically see if things have changed in your situation.

If the state looks at your income and decides you can pay $100 for child support, that's what you pay.

They won't come back and say that since you're making a lot more money NOW you should pay more for BACK THEN.

It's what you're able to pay at that time, forward.

Yes, it has always increased. However, most of the time we've agreed to an amount that was less than what the court ordered.
 
If either side requested a review, when a judgement is finally made, it will be retroactive to the date of when it was requested and the proper paper work was turned in.
 
In NY they will backdate the order amount to the date of application filed.
Don't get me started on the messed up child support system...I am owed as of today $12,883 and haven't seen a cent in 5 years.
But Dh who has an 18 yo in Ct-where child support only goes till 18 can file in NY-because DH lives in NY-so his ex filed 4 months ago and we have to pay $1004 a month. He had 2 kids with her and she had 1 and we had 1. No CS either way; well the 1 we had joined the marines and then she filed:confused3 This child is not benefitting at all from the $$; we got him a G1 phone for xmas and she won't even add the data plan for him-too cheap for the $34.99 a month-so we're paying that too.
Ugh- thanks for letting me vent.
It just makes me mad that all of the sudden she is remodeling her bathroom and new furniture-on our $$$ and the kid gets nothing.
 
I don;t like the disclosure of all the financial info, I don't think that should go to each person.
 
I guess if that is what is agreed upon, also, does yours end at 18? do you have to fill out a form to cease payments? I tried all over the FAQ's and it seems differing answers. The decree says 18, not whether in school or not, etc
 
Cousin's father just all of a sudden decided that since she was 18, he didn't have to pay anymore and he won't follow up with the CS worker regarding the letters she has sent. He is supposed to pay until she turns 19, unless she is a full time student, then it is 21 I believe, in AL.

At this point he has gotten away with giving the court forged tax documents, so he will probably get away with not paying either. He says he will just take her back, then kick her out so he doesn't have to pay :scared1: , great father, huh. Over my dead body.

It varies from state to state.
 
I see you live in fla- I believe it ends in fla @ 18. It should be info you can find online.:confused3 In NY it's till 21-period. Doesn't matter if they are in school or not. Only ends early if they get married or enter the service. And it's the same here with exchange of financial info.

Do you have any information about having a case transferred from one state to another?

No, I'm sorry I don't. We have always lived in NY;DH's ex wife lives in Ct-she can file where farther lives.
I would think they would go by the original state you lived in; where the support was ordered. But a free call to a family practice attorney in your state would be the best bet. Sorry, I couldn't help more.

Good luck with that! Every state is an at least of 18.
It sooo makes me mad we have to pay that much and yet I can't get a penny of what I'm owed. It wouldn't bother me as much if she was at least paying for his schooling with it-she made him take loans for all of college so far. And refusing to up his cell phone plan:confused3 he is still 18 and will be 19 in April so we have more than 2 years of $1004 a month.
Sometimes I wish I could bang my head into a wall...

Sorry, but it sounds to me like you need to get a lawyer in your area to answer the questions you have.

Each state is a little different. I know that I received reviews on my kids (many years ago) but I did not mind the fact that they would up the amout every few years.

And the age 18 thing, like some PP's have said, is kind of standard. I know mine stated that it would continue if they were in school, until age 21.

The cost of a lawyer on your side is well worth it.
