Catching up now. I see the defense is just doing it's job today, as usual. And that Judge Perry is obviously not treating them fairly. Doesn't he read here?

That darn duct tape is still the sticky issue (see what I did there? ;)) If the prosecution wants us to believe that is what killed Caylee, then it has to have been applied before she died obviously. But sooooo hard to prove that.

This would be a tighter case if the prosecution had not alleged that, and if the defense had just said drowning (without all the other stuff).



See that's why i don't think she's get convicted on murder 1 - it's soooo hard to prove premeditated murder over accident or .... unmeditated (is that a word?)
 
I agree. They say he testified before congress in the JFK and MLK autopsies. I think he did show that Caylee didn't die by being smothered with the euct tape over her face. I can't see Casey getting First Degree pre-meditated murder now with Spitz's info. It puts that doubt back out there for the jury.


I don't think anyone can really show that she died due to the duct tape over her mouth. ...with no tissue/lungs/skin etc to examine you can't really tell a lot.

It will be interesting to hear cross.

HLN is saying that the brain being on the left side but the bones being found on upright proves it was moved.

can someone please mention to the jury that FLOOD WATER could have moved, shifted the bones and it doesn't mean a PERSON (kronk) moved it

See, this is why I couldn't be a juror. I keep going back and forth with my opinions. Spitz has put doubt in my mind. Seems the duct tape was put there AFTER Caylee was already dead. So that's not how not how she died. Was this brought out before as evidence?

I can't believe both sides didn't pay an expert to test this theory out. They had three years to prepare for this (2.5 since the body was found). Why not have an expert put their DNA all over duct tape pieces and expose them to harsh environments for 6 months (heat, hurricane strength wind, flooding, tugging and pulling by animals) and see if there was any DNA left. I would have loved to see those results and those results would certainly sway my opinion one way or the other.
 
Applied before decomposition...duct tape stuck to the hair, and mandible remained in place (would have separated without duct tape and without root growth).
 
Ashton is making the doctor look like he doesn't know many details about this case.

My understanding (don't know if it is a correct assumption)---water could affect that.

And I'm guessing (guessing) heat. She would have decomposed quickly in the Florida heat, and everything was exposed to heat and water for months.

The house analogy isn't working for me.

Now that's an experiment that would've been great a!nd very interesting ... especially if it was done in FL and not in Nebraska!

Oh, snap!! Spitz says "Not opening the head was a failure; was a shoddy autopsy." Smackdown on Dr. G! However, I wondered why she didn't open the skull as well ...
 
He wants to get a upset because there is nothing in writing to do this. He says he wrote it? He says he has been out of the scope of things for a while. :eek:
 
ok - i do have to agree that dr G not opening the skull is strange.
 
Spitz just said he's been out of the mainstream of administrative forensic pathology for some time and angrily accused Ashton of provoking him. :eek:

I thought the FBI DNA expert covered that - that the degradation and absence of DNA was not unusual considering the circumstances.

Premeditation is NOt required and does not have to be shown or proven.
