I might believe the drowning scenario if she had told the police about it when it first happened. If it really did happen that way why would they wait until trial to mention it?

Why would you sit in jail for 3 years on death penalty case if it was an accident? Especially if your "molester" was the one who covered it up? Wouldn't you want him in jail right beside you?

It just doesn't make sense to me.

I love Judge Perry. Baez just got shut down again. Now Mason is trying to have the judge look at case law to have the videos kept out. Its not gonna happen guys. Bring on the videos!
 

There's a big difference between pretending to be happy and having "Beautiful Life" tatooed on yourself a few days after your child died.
Yeah, really.

Lessons to teach our children...
1) If you lie all the time, no one will believe you.
2) Never cover up an accident.
3) Don't write things on yourself you cannot take back.

And oh, so many more from this trial!
So the prosecution brought up the various videos of Casey out and about between 6/30 and 7/15/08, and Baez stated that he required "foundation" for these videos and Judge Perry had to SERIOUSLY pause and he repeated back to him "you require foundation???" Sidebar...
I LOVE when Judge Perry speaks slowly and distinctly and repeats things. Like yesterday, when he kept saying about the photo of the gas can "...NOT. IN. EV-I-DENCE." :lmao:And Jose gets that little boy who just got in trouble look. :laughing:
 
I missed what is going on (had to restart). Is there a video that the defense is complaining about or something?
 
The arguments Baez has are twofold. One is the continued argument that all of these witnesses are being used to show lack of remorse and that is not legal. The State counters that it is not to show lack of remorse but to show demeanor and that she was not actively searching for her daughter as she had claimed to police. Judge agrees again with State.

Second, Baez is claiming overkill. Point made and any further is unnecessary. Wanted that on record.

That's what I've been thinking. After all this time, you'd think Casey would rather face her abusive father and the lesser charge than the charge of murder.

Im assuming it is the videos showing Casey at different times. Shopping at Ikea, Target, JC Penneys, Home Depot.. There are a few of them.
 
Commentators just ran down a list of women who were never accused of being a bad mother, who killed their children. It happens. For whatever reason, it happens.
 
Jose actually sounded a bit intelligent when he said he wanted reiterate his objection due to the cumulative testimony that has been for an entire week (not exactly Jose but...) witnesses testifying about her activities that she was not searching for her daughter, it's been conceded by the defense and to continue to go down this area serves nothing and no purpose other than to show bad character. Judge Perry decided that it did not go to the issue of lack of remorse but to show her demeanor. some people feel that the death or kidnapping of a child would bring on certain reactions from a parent which Casey had not exhibited.

Okay--here is my take:

Anything regarding Casey's alleged ( and most definitely will be proven) thievery of money--they don't want use.

They don't want these videos used because they are evidence in a check stealing case from Amy Huzienga. Casey used her checks without permission and these particular videos were obtained into evidence for that charge.

HOWEVER----

On the state's side, these videos have become rightfully convenient. As long as they do NOT mention those charges, they can and should be able to use these as evidence to show a mom, by herself--without her kid, buying bra, undies, candy and what not.

So, bottom line--Defense is crying that they are being improperly used---but they show a woman out shopping and that is allowed per the claims of the state. So long as they don't pipe in about the check stealing or otherwise how she managed to pay for those purchases.

ETA: Not sure about the other surveillance, but the Target video is the purchase she made with a stolen check.)

I can see his point.

However--if they were allowed to go on the record and say "We have 27 additional witnesses to say the same thing" and then concede the rest of the list, I would be okay with that.

Jose just wants them blocked as if they did not exist.

That is not a fair trial. That is unfair bias he wishes to have towards his client, if he won't let the jury hear it.
