I'm confused by this as well, if opening statements cannot be considered as evidence or testimony then how can he ask people if they were there when she drowned. That implies that the drowning is a fact and DID happen, which is his opinion/theory NOT fact.

Its like asking Baez were you there when Caylee drowned? No, well how does that make it true.
 
When finished with this witness and Baez asks him if he was there at the Anthony house on June 16th, I wonder if the prosecution will follow up with asking if Casey ever told them that Caylee drowned.

Agreed--he should just be able to ask about the date. He should NOT be able to ask about a presumed alternate COD.
 

I like Judge Perry's style - way to put Bozo in his place! Have they said how many witnesses there are for the defense?

Wonder if he'll find ANYONE who was there when she drowned in the pool in the backyard. :rotfl2:

Anything a lawyer says is not evidence. Just because he asked the question doesn't make it true.

In an effort to confuse a witness, a lawyer could ask, "it was raining when you left the house on May 2, wasn't it?" Even if they weather was perfect. It's only the witness' answer that is evidence and may be considered by the jury.
 
I almost think the drowning theory works against Casey...if your child accidentally drowned and you were forced to hide it and lie by your father you would most likely be upset, distraught etc. Where as if you murdered your daughter at your own hands you would feel guilt and have more motive to hide it and protect yourself. All of these witnessess saying she acted normally, went out clubbing, etc. makes it seem like she was working hard to act normally and not show any guilt or shame at all. At least that is how I see it.

I don't understand why Baez is asking this witness if Caylee looked well fed and if Casey seemed to be a good mother. He only saw Casey and Caylee together 2-3 times. Can you really judge if someone is a good mother by only seeing them 2-3 times? And as far as her being well fed and well taken care of it wasn't Casey taking care of her 99 percent of the time, it was Cindy and george

He trying to establish she was a good mother and took care of her and did not neglect her. I find that a rather bizarre question coming from him since he has called stupid and said her behavior was all sorts of ways
 
I wanted to point out that last night on Nancy Grace they showed jailhouse tapes of Casey speaking to her parents saying how she was so thankful for them and that she couldn't ask for better grandparents for Caylee and how they have always been there for her. Now she says she has been molested by her father. Which one is it?:confused3
 
I understand that they will have court on Saturdays but this Saturday is Memorial Day weekend, I was thinking that they would take a 3 day weekend. Can anyone confirm? Also if they do take a 3 day weekend, can the jurors see their families?
