I don't doubt there will be legal filings from this incident, but none of them will involve wrongful termination. At least none of them would survive beyond the first hearing if they did.

The lawsuit would be against Disney, not the CM. The CM has no money. He looked like a college kid probably making $10 bucks an hour. There is nothing to win.
I'm not sure what the company policy is in the parks in regards to these types of incidents and the cast members actions, so I really can't offer an opinion as to whether he should be fired or not. Heck, I don't think it's even been determined that he's been fired, but that doesn't seem to stop this train either.

No, I'm simply saying that a case of wrongful termination would not be successful in a Florida court under these circumstances. That opinion has nothing to do with whether I feel he should or shouldn't be terminated.
The sad thing is, if Disney has in their Employee Handbook or Policy that CM's are forbidden to touch any guest (and they probably have specific language on physical altercations among guests), then he would get rightfully fired and have no grounds for wrongful termination. I do not agree with that whatsoever but a lot of companies have this as a policy. For example, Walmart employees can not restrain or prevent a person from leaving property if they know they are shoplifting. They have to notify local police or security and not stop the person or touch them. A Walmart employee chased and tackled a shoplifter and he got fired and the shoplifter went free. It's the litigious parts of the country that are wrong here. Clearly it's a black and white issue and the CM was trying to help.
So am I correct that no one is reporting what may have started this? Its hard for me to imagine what would have made something escalate to this level on a line at Disney, I have been going for so many years and have never witnessed anything but courtesy pretty much.
Wrongful termination claims would need to involve a legally protected class in the state of Florida. None of the other issues surrounding this incident will matter in any way if this CM were to be fired.
i watched the video several times and it is really hard to see who threw the first hit. To me, it looks like the girl in the goofy hat has her hands in the white girl's face. I can't tell if she touch the white girl or not. Then I see an umbrella whacking away. Again, I can't see if the white girl threw the first punch or not. It looks like the umbrella was used as the first hit, but then again it is really hard to tell.
Can anyone speak to how CMs are trained to handle such an incident? Is it a paragraph in a manual or role play or viewing recordings of previous incidents?
