Brawl at Test Track-Epcot

I would love to know who makes the laws? I always thought you could only sue someone if something happened to you. What could goofy head or umbrella woman sue for? Neither got hurt. They had to be stopped so they couldn't harm someone. Why on earth would they ever get a dime? Because their feelings got hurt that they couldn't beat someone up? The lawyers/judges in the country are out of control!!!!!!

Do we know yet, who threw the first shot?:confused3
I would like to know this too. It is hard to see much from the video but I think I see Goofy Hat pull the hair of the other woman as she turns back to walk away at the beginning. I could be seeing this wrong.

I think that when the woman starts using the umbrella as a weapon that it takes the fight to a whole new level. It was bad enough to be fighting with fists but introducing a weapon brings a new level of guilt.

Laws are made in several different ways, but usually it would be a sympathetic jury who give out some very strange and, in some opinions, undo awards where civil litigation is concerned.

As this country becomes more lawless, Disney should think about getting better security. Does Disney have security that could arrest someone? It would take a police officer forever to get into a Disney park if one was needed. What if the woman with the umbrella really hurt the other woman (poked her eye out), what would the CM's say as she was leaving, "have a magical day"?

They most certainly have security that are capable of detaining and holding an individual until a police officer arrives. They wouldn't have arresting powers specifically for Disney, but detaining and holding individuals would be quite normal in their capacity.

Just curious...may a teacher defend him/herself if he/ she is being assaulted by a student or must he/ she wait for security and/ or the police?

Interesting question but not even a teacher, let's just leave it with the CM. If a guest (female minor) is attacking a CM, is he just supposed to stand there and take it while waiting for Disney security? Disney Policy is can't touch a guest ever right? So I guess he just stands there and accepts his pounding.

I don't think any of us know exactly what Disney policy is as has been stated several times in this thread, but there are legal differences between protecting self and protecting others. I sincerely doubt that Disney has a written policy telling it's employees to "stand there and take it", as that would be absurd, but I imagine you already know that. What I think is very, very likely is that they have a policy telling certain classes of employees to not intervene or get involved in violent matters as they are not given the training to do so. Their involvement could escalate matters and also open up all kinds of doors for liability and litigation. They'd never instruct those same employees to not protect themselves from harm as that would also open them up to all kinds of litigation and liability.

Lawyers and judges do not give out the "dimes". Juries do. If a jury made up of people from your community are convinced that a person deserves money, they award it. If not, they don't. One of the biggest problems with our judicial system is that many people who would make the best, most fair jurors will do anything they can to avoid serving on jury duty. What is left are people who make decisions that leave the rest of us shaking our heads.

I couldn't agree more with this.

Funny that you mentioned this. A family tried this on Soarin' last week. The people in first were waiting when we got there, I assume for front row. They went in and grabbed the center seats instead of going to the end. We did not want to split our family up so we told them they needed to move. Same bit of we don't understand but they finally moved on down with a few angry glances our way.

Samantha Brown did a Disney special a while back and they showed her on Soarin'. She was first in line for row 1 and went right to the center seat while telling the girl behind her "the middle is better".

A properly constructed policy would not lead to charges of discrimination.

Which is what I have been saying. A policy of "do not touch a guest without permission" is clear cut. "Use your best judgement as to when to touch a guest" is not clear cut. Neither is "if you think you will be successful, try to break up a fight and we will decide afterwards if you should have done so".

I think what declansdad and I are saying is that the laws of nature, common sense, and decency supersede corporate bylaws.

That and even corporate policies can have varying levels in punishment built in. Policies do not have to be don't punish or fire immediately.

The behavior and class of people in this country has gone so far done lately. It's embarrassing.
Agreed. The popular media celebrates lowlife behavior and mocks Christianity and responsible behavior. Don't believe it? Jerry Springer. Honey Boo Boo. Jersey Shore. Kardashians. Real Housewives. Anything with Paris Hilton. Etc., etc., etc.
