Brawl at Test Track-Epcot

I am in HR so I try to clear that up when people are confused. I do agree with your point. Wrongful termination law is also very misunderstood. If one of my employees got between 2 customers who were fighting, we would definitely fire them.


Without any discussion? What if the employee was an exemplary employee?
 
I believe this part: So What?? They could have talked / yelled at her all the way through the line. She had no business walking back to where they were. People can talk smack all day long. You can ignore it, talk back or call a CM in to call security. Walking back to confront them ( and I think throwing the first punch ), took the whole thing from a verbal confrontation to a physical one. was from you and it ended up in your quote of me.

Basically, you are saying that girl#1 shoulders the entire responsibility for the incident. She should have walked away. She should have ignored everything. And because she didn't, you believe she threw the first punch; even though you can't tell from that video if she actually did or not. And the fact that charges haven't been issued (at this time) confirms that she instigated it.

I just don't see what you are seeing from what was on that video.

I think both parties are guilty.

The woman should have kept walking instead of walking back to confront the kid and her mother. Did she hit first? I can't tell from the video. But my gut(and growing up, teaching and still living in the hood) tells me that the kid and her mom didn't just start throwing punches for nothing. I think that woman hit one of them and caused the fists to start flying.
Up until that point it was just a bunch trash talking.

Yes, she should have kept walking away from them. They were separated~still talking trash~but there was a bit of distance between them.
 
Somebody mentioned it was going to be on the news where they live? Did they have any more information? I'd love to hear from witnesses to see what this was all about.
 
There's so many crazy people these days, that I wouldn't even get in a confrontation with any of them. Even if the umbrella woman was 100% wrong, I would of smiled and said "have a nice day".
 

Sorry if I wasn't clear / I was referring more to the Epi Pen comment than the CM in this fight.
The good Samaritan law would have prevented me (personally) from being sued by the boy's family. It would not have prevented me from being fired. If the situation would have actually happened, they absolutely could have (and would have) fired me for disobeying company policy.

Getting fired from a part time, minumum wage job would not have been the end of the world for me.

I dunno...If I were to get into a bar room brawl in the Test Track queue at Epcot, I would definitely want to get into it while wearing a Goofy hat in-case it did make it to Youtube.

However, wouldn't the same issue arise? If it's employer policy to not administer medication, then I'm not sure what else could be done. Many employers will have such a policy even if there's little risk of liability in a particular state. A lot of companies have the same policy that applies nationwide without being individually tailored for different laws.
I'm not going to argue the point. I'm only saying that policies against the administration of a lifesaving drug due to "liability" are not necessary because of Good Samaritan laws... Edited. Removed off topic babble & add: I'm not saying violating policy won't get u fired, only that the policy isn't necessary...at least not for liability.

That was another kid not a woman. From the way it looked in the video, walking away would not have helped your gut notwithstanding.

If this were to happen in my classroom both parties would have consequences. It doesn't matter who started it or who hit first. You put your hands on someone that's it. The self defense argument very rarely flies at school. I have always taught my students that when someone starts trash talking you just make a pleasant face and say nothing. It's always more entertaining to watch someone try to argue with someone who refuses to engage. It also draws attention to the person instigating so that security/cm/teachers/whomever is in charge wherever the incident is taking place can deescalate the situation.

Doesn't matter. If you don't apply rules consistently then you have issues any time you want to apply them.

When we watched the video last night I told my wife that that CM was going to get fired and the woman swinging the umbrella will file a lawsuit.
