Aspie Daughter injured on Dream!

Thanks to all for concerns. We are in contact with an attorney, though it is a family member. We haven't hired anyone (yet). Disney has made no offers, I won't cash/sign anything without an attorney reading/advising first.
How did we get from Florida to Nevada? Sheer ignorance. Poor child was in a huuuuuuuuuge amount of pain. Ibuprofen was all we had. We had no idea she was as broken as she turned out to be, of course. She could bear no weight at all, so she was in wheelchair from ship to plane to plane to car, to ER. Morphine seemed a real blessing at 1:30am.
 
the last I heard, a week ago, Disney's Risk Management dept. was "investigating." This investigation has NOT involved talking to any member of my family or asking for any medical reports from any doctor. Total silence.

This is NOT being handled well, by Disney. I am a long time disneyaholic. I've often been teased that I don't own any article of clothing that does not sport a character. I collect snow globes. Friends come to me to plan Disney park trips. We took almost every foster kid we ever cared for to a Disney Park.......My kids baby albums are punctuated, liberally, with characters........

Please, Disney, don't make me take back all the things I said about how well you take care of your guests.........
 
It is less than two weeks since the date of the accident. They have to start with the records that are on the ship itself and then go from there. It does take a while to get the internal paperwork started, and then they have to go to the ship while it is in Port.

Once they see that an accident did happen on the ship and that service was provided is when they will go further. They know that you have submitted an initial claim and they know what your original thoughts are.
 
First, I agree with Cheshire about the timing--it has not been that long and in the meantime your daughter is getting the medical attention she needs so getting an answer back from Disney is not an emergency (even though I know it would make you feel better).

Second, please be very cautious about posting anything about this matter on a public board such as this. (And this advice goes to anyone who is in a lawsuit, a divorce or any other dispute. DON'T DO IT! I can't believe some of the things I've seen posted on the DIS, Facebook, etc. If their attorneys knew they would be mad!

Even the most harmless remark COULD be used by an innovative attorney to build a defense. I was just reading this morning about people who either lost their jobs or lawsuits because of things they posted on public boards that were used by the other side. Everything you post here is also discoverable and an "admission" (a legal term--not that you are saying anything bad).

If it were me I would keep this between myself and Disney and your lawyer. Although I know you wanted to vent and want reassurance the old "anything you say can and will be used against you" applies here as well! (and yes, I am an attorney).

Third, I would check your medical policy. In many cases the insurance company has a duty to make the insured "whole" as well as itself and cannot settle the case without the consent of the insured. Of course, you need to check your policy to see if this applies to you or not.

I get it, and thanks for the advice. Just to let everyone know, surgery went well, there is a bit more hardware in her leg than originally thought. She is home and grumpy, but recovering.
 
I am SO SO SO sorry for this accident. I know that your first concern is the suffering your poor daughter is going through - but please think thru whether you want to "sue for damages" above costs. NOT that you have once suggested that I might add.

I am a physically disabled senior. I tripped two weeks ago on a deck at a rental property in CA that had no safety markings. I was knocked unconcious and am still suffering some headaches. I had to have STAPLES in my head!

Especially with this being California I know that I could sue for a substantial amount of money - but I am not going to do that. It just would not be right. I am not happy that my vacation was so disrupted - but just having my medical expenses covered is enough.

But the most important thing is that I hope your daughter is improving everyday. Give her a hug from all of us and tell her that lots and lots of people care about her.

I have never even used that word! My daughter was injured due to the negligence of someone else. She is suffering (and will be for many weeks to come). I am dismayed and wish to have the experience acknowledged by the responsible party(ies). I never said anything beyond that. My daughter has been crying on a daily basis, due to pain. She has also visited a disney park or ship annually since becoming a member of this family. Her brothers have never gone a full calendar year without some sort of Disney trip. We, as a family, have always felt Disney was the company to emulate when it comes to Guest Service.
I am hoping that they will make some sort of move that supports that feeling, in this instance. Thus far, it has not happened. I am disappointed by that. I have never suggested that I was expecting or asking for anything other than that. Please do not (everyone) advise me any longer. I have advice here, near home. I was coming here to sound off as the mother of an injured child with special needs. It seemed like the appropriate venue. If I want legal advice I will seek in with an attorney.

You posted on a public forum. People are going to offer advice. People are going to sympathize. People are going to supportive. People are going to be critical. If the advice or comments are going to offend or bother you, you should probably just not check back on this thread. It is the way of the world.
