In cases where there is no hope for a cure and the chemotherapy would only prolong the pain, I agree when parents would like to stop their child's suffering. I completely side with the judge on this one though! How could you not tell your cancer-ridden son he was sick?!

Arrest ordered for mom of boy, 13, resisting chemo

By AMY FORLITI, Associated Press Writer Amy Forliti, Associated Press Writer – 1 hr 7 mins ago

NEW ULM, Minn. – A judge issued an arrest warrant Tuesday for the mother of a 13-year-old boy resisting chemotherapy after the pair missed a court hearing on his welfare.

Brown County District Judge John Rodenberg also ordered that Daniel Hauser be placed in protective custody so he can get proper medical treatment for Hodgkin's lymphoma.

The cancer is considered highly curable with proper treatment, but Daniel quit chemo after a single treatment and with his parents opted instead for "alternative medicines," citing religious beliefs. That led authorities to seek custody. Rodenberg last week ruled that Daniel's parents, Colleen and Anthony Hauser, were medically neglecting their son.

The family was due in court Tuesday to tell the judge results of a chest X-ray and arrangements for an oncologist. But Daniel's father was the only one who appeared. He told Rodenberg he last saw Colleen Hauser on Monday evening.

"She said she was going to leave," Hauser testified. "She said, `That's all you need to know.' And that's all I know."

He said his wife left her cell phone at home.

The family's doctor, James Joyce, testified by telephone that Daniel's tumor has grown and he needs immediate assessment by a pediatric cancer doctor.

Joyce said he examined Daniel on Monday, with an X-ray showing that his tumor had grown to the size it was when he was first diagnosed.

"He had basically gotten back all the trouble he had in January," the doctor said.

Daniel was accompanied by his mother and Susan Daya, who Joyce said was an attorney from California.

Joyce testified that he offered to make appointments for Daniel with oncologists at Children's Hospital, the University of Minnesota, Mayo Clinic or elsewhere, but the Hausers declined.

He also said he tried to give Daniel more information about lymphoma but that Daya, Daniel and his mother left in a rush.

"Under Susan Daya's urging, they indicated they had other places to go," Joyce said.

Daya did not immediately return a page left on her cell phone Tuesday by The Associated Press. Her voice mailbox was full.

Besides examining Daniel's chest X-ray, Joyce also said he asked Daniel how he was feeling. The doctor said the boy told him he had pain on the right side of his chest, which Daniel rated a 10 on a scale of 1 to 10.

Joyce said the pain was around the port that was inserted into Daniel's chest to administer chemotherapy. He attributed the pain to the growing tumor, which is pushing the port out of place.

Daniel also told the doctor he had a cough, though he wasn't having any trouble breathing, Joyce said.

Daniel's court-appointed attorney, Phil Elbert, asked Joyce if Daniel was at risk of substantial physical harm if no action is taken. The doctor said yes.

In his ruling last week, Rodenberg wrote that he would not order chemotherapy if Daniel's prognosis was poor. But if the outlook was good, it appeared chemotherapy and possibly radiation was in the boy's best interest, he wrote.

Daniel's lymphoma was diagnosed in January, and six rounds of chemotherapy were recommended. Daniel underwent one round in February but stopped after that single treatment. He and his parents sought other opinions, but the doctors agreed with the initial assessment.

Colleen Hauser testified at the earlier hearing that her son "is not in any medical danger." She said she had been treating his cancer with herbal supplements, vitamins, ionized water and other natural alternatives.

Rodenberg wrote that state statutes require parents to provide necessary medical care for a child. The statutes say alternative and complementary health care methods aren't enough.

He also wrote that Daniel, who cannot read, did not understand the risks and benefits of chemotherapy and didn't believe he was ill.

Daniel testified that he believed the chemo would kill him and told the judge in private testimony unsealed later that if anyone tried to force him to take it, "I'd fight it. I'd punch them and I'd kick them."

The Hausers, who have eight children, are Roman Catholic. They also believe in the "do no harm" philosophy of the Nemenhah Band, a Missouri-based religious group that believes in natural healing methods advocated by some American Indians.

Well it's based on a religious decision, and we're not allowed to debate that topic here.

I'm trying to get past the part where he can't read. How does that still happen?

And it's not like he lives in a 4th world country, where there's no access to books or anything that could teach you to read. Maybe he has a disorder? Maybe it's something where he can't learn, and reacting REALLY badly to bad news is another symptom? I'm curious popcorn::

He has a developmental delay of some sort.

.

God Bless young Daniel and may his court ordered medical treatment bring a speedy and full recovery.

This infuriates me! Okay, this kid needs to grow up. I can say that because I was that 14 year old with cancer - it's life and you need to accept that YOU ARE SICK!

Besides that, you do not treat cancer with herbs alone! Yes, they help, but you do not TREAT cancer that way - natural remedies and chemotherapy combined have great results. My oncologist actually recommended some foods that help when you have cancer, but also said they will not treat the cancer alone.

Ugh, I'm sorry. I know this post totally doesn't make sense, but it really chaps me.

I really hate to say this but my first thought was that the parents look at this as a way unburden themselves of a disabled child. I really hope this is not the case.

Tonight's news: Mom is on the run with Daniel, who sadly only stands a 5% chance w/o immediate treatment. :sad2:

Wow, that was quite a challenge you had at 14. I can understand how you feel. I think the parents are the issue with this young man. Withholding treatment is abuse. I don't think the parents have been "helpful". I am glad that the judge has intervened. God helps those who help themselves.

Did you hear the sound of the buzzer? That says that the statement is wrong. (yes I changed the way I said that, I just get so ANGRY at American "culture" and the religion of western medicine...western medicine has gotten control of the laws, the courts, everyone, and it is ridiculous and harmful to MANY people) Almost 10 years ago my husband healed a brain tumor withOUT any western medicine. Hyperbaric chamber treatments, enzymes, a severe macrobiotic diet (no fish b/c the fish we can get in America fish are so polluted). By the first post-diagnosis MRI it was already shrinking. Inside 2 years it was gone. Never a bit of radiation, not a drop of chemo, and it was inoperable.

He had to fight the diagnosing doctors at University of WA Medical Center. He had to hire an attorney to protect him b/c they were threatening him with being committed and treated against his will.

He was making about 20K a year and had to pay for all of his "alternative" treatments out of pocket. No one could "treat" him for the tumor, b/c in WA, at least, it's not legal for anyone but an oncologist to "treat cancer". So it was all considered supportive for his body's immune system, not treating it.

And it's gone, and by the time I met him it had been gone for a couple years.

If you read a bio of Dirk Benedict, you'll find out that he healed testicular cancer in just about the same way.

You don't hear about it b/c the doctors can't talk about it, b/c it's not allowed for people to treat cancer patients (for the cancer) in any OTHER way than the drugs or radiation.

But just b/c you don't hear about doesn't mean it doesn't happen every day.

If and when this child dies, his stupid mother should be charged with murder.

And if he dies because of the treatment? Or how about despite the treatment?

Or how about because of something else they did along with the treatment?

My mom died b/c of a missed diagnosis of a bleeding ulcer, which was exacerbated b/c of the blood thinners they still had her on, despite being in remission from leukemia. Her doctors stopped billing when my stepdad reminded them of the four BIG symptoms she had in the month before she died, that they laughed at, ignored, and said "huh, that's weird" to. He could have sued them, righteously, for who knows HOW much money for missing that...after all, her chiropractor daughter, within a moment of being told the symptoms, had diagnosed that bleeding ulcer. Shouldn't have been that hard for the MDs, but they missed it, and they slunk away and stopped billing (even insurance), after stepdad reminded him of that.

So, if he dies because of or despite the western medical treatment...you'll be 100% behind the doctors taking full responsibility????????

Of course a grown adult should be able to make the decision what they believe to be in their best interest. This situation is a debate on whether parents or courts should determine these issues.

And some tumors regress spontaneously for no apparent reason. Your DH was lucky. Medical science knows, that with proper treatment, this child can be cured. If you have had good luck with your choice of care, you and your DH are adults. Children do not have the life experience to make these life and death decisions. If he died despite western medical treatment, it will be unfortunate but he will have been given the best chance that he will have ever had. If you believe in "alternative care", that is fine. For you to tell someone, who has survived cancer from the age of 14 that she is wrong, is "just wrong".

Well, in this case you said "brain tumor". Not all brain tumors are cancerous, just like not all bone tumors are cancerous, etc. Did your husband have MRIs, CT scans, etc to confirm there, in fact, was a tumor there and not just a cyst?

DawnCT1, thank you. It was tough and you bet I complained, but there was nothing I can do. All I could do was sit back, fight, and pray to God I would be healed. Thankfully, I have been cancer free for 14 months, and I am going back in a week for my next check-ups.

Good for you!! That is something to celebrate! :cheer2: Please keep us posted on your followup, and after what you have been through? You have earned your screen name. Be the biggest BRAT you want to be! ;)

I really don't know I feel about this. I know through prayer God will and does cure people.

Then again I think the parents should do everything in there power to save this boy.

Good luck with your check-up.. With your fight and strong will, I'm sure the report will be a good one!! :thumbsup2

You go girl!

On this case of the 13 year-old boy: the Mom sounds like a nutt! I hope they find them and throw her in the slammer for endangering her son!
