Hi DVC fam. Long story short, my entire family got food poisoning from a restaurant at a DVC property on day one. Couldn’t leave the room for the entire four day trip. I realize it’s a long shot, but can I get park tickets refunded?

Or what about some compensation from the resort, who needless to say, DROP THE BALL BIG TIME and I WILL be contacting management higher than those at the resort. I’m still beyond livid how we were treated.
 
Did you use any days on the park tickets? If not, they do not lose value and you can put them toward the purchase of future tickets. If you did use them, I would go to the concierge at your resort and ask if anything can be done.

We used our day one tickets, out of the four, and that’s all we will use unfortunately.
 
There’s really no way to even prove it was food poisoning. But you can ask. Disney used to be very good about surprising guests with pixie dust. Maybe they will sprinkle some your way.
 
Are you the DVC owner , renter or cash customer? If owner, do you have the DVC insurance?
 
If you are making a claim that a restaurant which Disney owns caused the food poising they will give you the information for Disney's Legal department who will investigate your claim and settle it based on their findings. I would strongly suggest if you are sick that you state to the CM that you came to Disney and..... were not able to..... can you give us credit for......
if you state it was their restaurant they take it serious and if they come back with no one was sick that night nor the day before or after based on the staff calling out sick being sent home sick other guests etc you will get nothing and your only option would be to hire a lawyer or appeal to a very adiment person you are only asking for..... who may or may not agree to do anything for you. Stating Disney caused X will have a bad reaction from staff as they have to let the legal department deal with it in case you are looking to sue.
 
I think if you have tickets with only one day used, versus a confirmed hotel stay showing you were on property the whole time, that might be a compelling argument to take to Disney. The counter-argument that you had tickets, were there on property, and simply chose not to go to any parks for 3 of your 4 days would be a hard one for Disney to throw back at you.

If you had used the tickets, but were claiming you didn't enjoy their full benefit in the parks due to sickness, that might have been a harder sell, but that's not the case. They may at least provide a credit equal to the unused portion of your tickets.
 
What people think is food poisoning is usually not actually food poisoning (bacterial toxin mediated), but regular viral gastroenteritis, such as norovirus, rotavirus, or enterovirus. If you all got viral gastroenteritis, you would have been exposed about 12-48 hours prior to symptoms, so you may have gotten it at home before you left. Sorry for the bad luck in the timing for your trip. How frustrating.

Both of these folks are giving you good advice.

I've had food poisoning, in Rome. We had a party of about 15 people, and the five of us who ordered the beef that night (we were not related to each other, did not travel together, and were not staying in the same room) were violently ill within six hours. No one else was, including the spouses who ordered the chicken. It wasn't complicated.

Even food poisoning can take longer to develop, and so even if that's what it was it may not have been from the restaurant you think it was.

I'd start with "We've all been sick, couldn't use more than the first day, and are wondering what you can do." If that doesn't produce something you can go the accuse-of-food-poisoning route, but I'd save that until and unless the simpler thing doesn't work. My BIL was in this position last March, and the CM he spoke with was able to give him a credit for the unused portion, though I think it expired within a year or two.
 
Maybe use the term ‘Bad reaction to food at XYZ restaurant’ in lieu of food poisoning- but yeah - definitely try to get a refund!

I agree with Brian on this. It is a terrible outcome, but trying to prove it was food poisoning will be difficult. I think asking for help will go further than demanding relief. I hope they can get you sorted out and you can get the whole thing in the rear-view mirror.:)
 
As an aside, my wife keeps telling me I should avoid (among other things) medium-rare hamburgers, raw oysters, and sushi now that I "know better". My response? The joy of those things outweighs the once-every-25-years risk of something going wrong.
I would agree. However, on a rented point stay we had a nearly identical issue at another resort.

Thankfully, as a litigator and my wife being an RN they had a snowballs chance in you know where trying to talk their way out of claiming any responsibility from their food.
 
Curious to know the outcome and whether or not they issued a refund on tickets...
