another ebay question

We live in florida and lost most of our stuff from hurricane ivan.One of the things i have been trying to replace were disney ornaments.
I recently bought 13 from a lady off of ebay. i paid on jan.2 and recieved my item via ups today. The box was a cut up box and reattatched with tape to make a traingle shape box. 2 of the ornaments are missing, and 11 that are in there are all broke up, and some missing peices that are not even in there, that couldnt even be glued back since are missing. some of them have a grey glue stuff on them so i know they have been glued before.
I have sent the seller 3 emails asking her what she wants me to do. (i paid $15.00 just for the shipping, and i know it didnt cost that much) 2 are missing, none are usable, and one isnt even disney but a precious moments one, and all of them are filthy.
I even asked her in the emial if she wuld like me to take digital prints of the items to let her see the consition.
I have read on her feedback that a couple people have said that she was a bad packer and things were dirty.
Is my only recourse to just put a bad feedback on ebay for her?
What really disappoints me is I just wanted to start replacing some of the disney ornaments. this year i was so sad when i couldnt put up my disney tree. :guilty:

How did you pay? Paypal wont refund for not as described in most cases however you should still file with them so that if you used a credit card you can then turn around and file with them

Ebay also has a claim process that has a $25 deductible but not sure how that works.
 
nope i didnt pay for insurance becuase it stated not offered, becuase it was sent ups. And i paid for the item through paypal but it was through instant transfer from my bank. ughhh.

I'm so sorry for your losses and all the hardship that you've already suffered from the hurricanes. This only adds salt to the wounds.

Take the photos of the box and the ornaments, showing the condition of both and the poor packing job that the seller did. Even if you did not purchase insurance, she had a responsibility to ship the items in a manner that would help to prevent breakage. UPS (even with insurance) would not reimburse for damages caused in normal transit when reasonable care has not been taken to prevent breakage.

If you do not hear from the seller by today, file a complaint with PayPal to get your money back. Tell them exactly what you told us...no replies to multiple emails, missing items, poor packing resulting in breakage. PayPal will try to resolve the problem even if you did do a direct transfer from your bank account instead of a credit card.

You can also file a complaint for free with SquareTrade . This is eBay's preferred method of dispute resolution. You do not have to pay for this service unless you want it to go to a mediator.

And when it's all over, do not hesitate to leave negative feedback. People like this seller are the reason why many people are reluctant to get involved with eBaying. You would be doing the rest of the world a big favor. Good luck recovering your money. Keep us informed.
 
UPS automatically insures every package for up to $100 I believe. You didn't state what you paid, but maybe this would cover it? Contact UPS IMMEDIATELY!!..........P
