Andrea Yates released on Bail--going to Rusk

Just saw her atty on live feed from the courthouse and they did release Andrea on bail and she will be awaiting her new trial at Rusk--which is a mental health institution.
 
I have mixed feelings about this. If I knew beyond a doubt there was no way she would be realsed or could escape from the mental facility then I would be all for it. There is no doubt in my mind that she is seriously mentally ill and that if her husband had only followed her Drs advice, the children would still be alive. I blame the husband equally, if not more for the childrens' death. I only wish there was a legal way to punish him.
 
I feel that's the right thing. She was clearly mentally ill. She doesn't belong in a prison population. Put her someplace where she can get help and be kept safe from herself.

What did her husband fail to do? I hadn't heard this before?

Don't hold back, tell us how you really feel!

I am torn on this point as well. I have a father that should have protected us from my moms alcoholism but didn't, so I agree in principle.
 
She put those kids in the tub and held them down till they drowned, one after another 5 times, 5 little lives taken. Of course she's mentally ill, how could one not be when they kill their children but I don't care, she needs to pay for what she's done. I think they should nearly drown her everyday for the rest of her life, let her know the fear those kids felt in their last minutes, as the person they trusted most in this world, their mommy, killed them. I feel NO pity for her, she's a monster.
 
This is going back awhile but The DR told the husband NOT to leave the children alone with her.

The 2 meds she was on are now known to be dangerous.

I think there is alot of guilty people involved.

Amen! She is a monster and should only be going to one place...hell.
 
He also wanted to have "all the children that God would give us"
And she homeschooled- She was in no shape to homeschool.

Just hearing this story retold makes me sick to my stomach. I just remember one of the kids saw her doing it and she had to chase him around the house to get him and drag him into the tub. Those poor children. I also think Rusty Yates was and is just as responsible for killing those children.

Yikes, that's harsh. The woman is totally mentally ill and always will be. She should be in a mental hospital. Her husband is the person that should be in jail. :furious: She will be punished every day for the rest of her life....every time she realizes what she did. She's in a living hell...there can be no worse punishment than that.
 
If I remember from way back didn't the doctor say he told them not to have more kids because of her history with post partum depression, and she wasn't getting better? Yet they had more because as her DH said, they would have as many kids as God gave them? He knew what shape she was in, yet she was home alone with those kids all the time. He knew what her state of mind was,yet he left her alone with the kids. He should share the blame in this tragedy too. If a person beats and kills a child and the other parent allows it aren't they usually also charged with something because they allowed the abuse to happen? Where is the difference here?

I also agree that she is mentally ill and a regular prison setting isn't for her. She needs to be under care and still locked up. A mental facility serves both purposes.
 
I wonder who is paying her Bail?

Rusk is the State Mental Hospital. Moving her there is simply moving her from the State Mental Hospital associated with the prison to another State Hospital.

Bail is appropriate since she is currently not legally guilty of anything.
 
Does anyone besides me worry that she might get pregnant again if she is "out on bail"? Being in a mental hospital is not as restrictive as being in jail.

I think if her DH enters back into the picture that could be an issue. As I recall she really hadn't wanted to get pregnant that last time. I think that was the breaking point. I also agree that her DH shares some of the responsibility in the deaths of their children. After the 2nd to last child was born the doctors told him they shouldn't have any more children. He didn't want to listen. She was just a ticking time bomb waiting to go off.

They are divorced now
 
this is a sad, tragic situation.

as for punishment-andrea yates, once she became lucid and truly aware of her actions she began "living with" the reality of murdering the children she loved and adored. in my opinion she is living a day to day hell. in a mental facility she will be forced to constantly discuss and address these actions which in my opionion will be far more punishing than sitting in a prison cell with the ability to ignore/deny the entire situation.

as for accountability-i find it interesting that none of the medical professionals at the psychiatric hospitals where her husband had her as an in-patient for treatment and deemed her soon before the tragedy well enough to return home and interact with the children (but were later found to have made those decisions solely on the fact that her insurance coverage had run out and would not pay for further treatment) do not hold some accountablity.
i also have not seen any legal action taken against the "hired" expert for the prosecution who has now admitted to fabricating and presenting false testimony (the jurors said that they would have ruled initialy for a mental hospital sentence-but when they were told by the prosecution witness that andrea had likely viewed a "recently aired" episode of law and order-which he claimed to have written (and is now known never to have existed)-that mirrored the events of the drownings and a woman's claims of mental illness, they were swayed to dismiss her mental status). seems to me he should be held accountable within the criminal justice system.

i hold her husband accountable for continuing to engage in having children once her mental issues became apparant-but i also question her family's part in this. if they were (as they have publicly stated in the media so many times) so concerned with the welfare of the children why did they not involve children's services? if god forbid, i had a family member who demonstrated mental issues such to endanger themselves or their children and for whatever reason they/their spouse was unresponsive to my concerns i would be at the door of children's services with everything i had observed, been told, overheard....her family claims they did'nt because they did'nt want to alienate themselves from the grandchildren-now they have no grandchildren from which to be alienated from

i think these babies were subject to tremendous neglect based on the actions/inactions of many people. it was a tragedy foreseen by many who never took the appropriate steps to prevent it.
