Just saw her atty on live feed from the courthouse and they did release Andrea on bail and she will be awaiting her new trial at Rusk--which is a mental health institution.
What did her husband fail to do? I hadn't heard this before?sha_lyn said:I have mixed feelings about this. She will be punished every day for the rest of her life....every time she realizes what she did. She's in a living hell...there can be no worse punishment than that.arminnie said:Does anyone besides me worry that she might get pregnant again if she is "out on bail"? Being in a mental hospital is not as restrictive as being in jail.

I think that was the breaking point. I also agree that her DH shares some of the responsibility in the deaths of their children. After the 2nd to last child was born the doctors told him they shouldn't have any more children. He didn't want to listen. She was just a ticking time bomb waiting to go off.

as for punishment-andrea yates, once she became lucid and truly aware of her actions she began "living with" the reality of murdering the children she loved and adored. in my opinion she is living a day to day hell. in a mental facility she will be forced to constantly discuss and address these actions which in my opionion will be far more punishing than sitting in a prison cell with the ability to ignore/deny the entire situation.
as for accountability-i find it interesting that none of the medical professionals at the psychiatric hospitals where her husband had her as an in-patient for treatment and deemed her soon before the tragedy well enough to return home and interact with the children (but were later found to have made those decisions solely on the fact that her insurance coverage had run out and would not pay for further treatment) do not hold some accountablity.
i also have not seen any legal action taken against the "hired" expert for the prosecution who has now admitted to fabricating and presenting false testimony (the jurors said that they would have ruled initialy for a mental hospital sentence-but when they were told by the prosecution witness that andrea had likely viewed a "recently aired" episode of law and order-which he claimed to have written (and is now known never to have existed)-that mirrored the events of the drownings and a woman's claims of mental illness, they were swayed to dismiss her mental status). seems to me he should be held accountable within the criminal justice system.
i hold her husband accountable for continuing to engage in having children once her mental issues became apparant-but i also question her family's part in this. if they were (as they have publicly stated in the media so many times) so concerned with the welfare of the children why did they not involve children's services? if god forbid, i had a family member who demonstrated mental issues such to endanger themselves or their children and for whatever reason they/their spouse was unresponsive to my concerns i would be at the door of children's services with everything i had observed, been told, overheard....her family claims they did'nt because they did'nt want to alienate themselves from the grandchildren-now they have no grandchildren from which to be alienated from
i think these babies were subject to tremendous neglect based on the actions/inactions of many people. it was a tragedy foreseen by many who never took the appropriate steps to prevent it.
