Am I supposed to get bylaws, rules, offering statements, anything?

Hi everyone, as you can tell, I am a new member. I am wondering if someone could help.

We just purchased at BWV and got a new member packet from MS. This consisted of an envelope with 2 really nice Disney magazine-type brochures inside. However, it did not contain the nitty-gritty legal mumbo jumbo stuff. I suspect that I can find the "real" stuff in the bylaws, rules or offering statement. Does anyone know if I will get these?

I did send MS an email asking for this (through the DVC member web site) but got no response to that email (for more than 1 week) :badpc: . Does anyone know where I can get this information?

We got all of that when we got our packet of stuff to sign and date. Not sure why you didn't get the offering statement then. I guess I wouldn't have wanted to sign on the Mickey's and date on the Palm trees until I read that.

We purchased resale, and we were never asked to sign a document with the little Mickey Palm trees. All I signed was an agreement of sale, and of course, authorization to wire money.

In fact, I asked where the documents were for us to sign from Disney, and I was told there weren't any. We got our title insurance and deed (which was recorded) so I know I am an owner, even without this info.

Is this unusual?

We bought resale also and didn't receive bylaws from Disney. When I asked DVC about it, they said that the bylaw information is only required when you buy directly from a corporation (Disney) and not when you buy from an individual.

If I'd have pressed for that stuff I'm sure they would have mailed it to me but I wasn't too worried about it. We wanted to be DVC members, rules or no rules.

No Mickeys and palm trees?!? Yet another factor in favor of buying directly through DVC. :cool1:
 
The short answer is that DVD / DVC is only required to make disclosures in the form of the POS, etc. when THEY are the seller of the contract. Since you did not buy from DVD / DVC, they have no obligation to provide that information to you.

I know their response is probably leaving you with a lack of warm fuzzies, but really if you had questions about what you were buying (which is really what the POS serves to define), they should have been posed to the seller and/or his agent.

It's basically the same as buying a house that another family has lived in for 5 years since construction. The original developer is under no obligation to provide you with any information about the dwelling--that onus falls upon the party from which you are presently buying the property.
 
Ah yes, resale is a different thing. When our friends bought a resale contract, they asked for that packet from the sellers and received it, but not until after the purchase was complete.
