Ed's answer is "butts in seats". As long as everyone is planted on a seat (3 in front or 3 in back), you're probably okay. No one sitting in another's lap because if the drives hits the brakes, too much momentum could send the lapper flying.
Questions also come up about infants. If they are held firmly by an adult in the front passenger's seat, okay. Infants are NOT to be held by the driver. (duh). Car seats should be bungeed/strapped/belted firmly into position if used.
