Totally agree.

I think it's sad there people seem to be hinting that it was in some way the family's fault.

It doesn't matter if her records are released because I doubt anything the hospital has to say can really be trusted. Their main goal is to protect themselves.

I feel terrible for this family.

Exactly. I can't wrap my mind around that. It almost sounds as if the family pushed for the surgery, when it was the doctors who said she should have it
 
There is absolutely no way you can know this. Just as you cannot know how the surgery was presented to the family in terms of the risks involved.

Just like there is no way for those who are defending the hospital to know that they were not at fault. We're all speculating here
 
At this point does it really matter whose fault it is? The child is brain dead. The parents need help in coping with this horrible situation and accepting that their child is gone. In the weeks and months to come I am sure both legal and medical minds will determine fault. Right now this family needs the support necessary to make the difficult decision that must be made. Hopefully it will be them coming to terms with the situation and not the "system" that forces the conclusion to this. They are living a parents worst nightmare.
 
I would be more inclined to be on the parents' version of what happened to their daughter if they would let the hospital speak....but they refuse to do that. There is some reason.

We may never know what happened. I'm certain there will be a lawsuit of some sort, and if it goes as these things generally do, there will be a confidential settlement and we won't know anything more than we do right now.

I do know that EVERY surgery carries risk. There's a reason you sign papers saying you know you can die...it's always a risk. Just because it happens infrequently doesn't mean that when the worst happens there must have been malpractice. There may have been. There may not have been.

I must say that I find it very hard to believe the parent's version of the story about her bleeding profusely and no one caring. Children's Oakland is an excellent hospital that provides exceptional care. It seems bizarre, and that makes me suspicious of the parent's claim that they are free to make without any opportunity for the hospital to respond. That's not fair. If it is as horrible as the parent's say, they would not be afraid to let the hospital speak. Those without facts on their side are afraid of the other side. Those with truth on their side are not.

She probably should have had the surgery. No one makes those kinds of decisions without really weighing the risk vs. benefit. Sleep apnea is never normal for a child and can cause a host of medical and mental issues. The symptoms the girl was having can all be attributed to sleep apnea and its resulting chronic poor sleep quality. The surgery was an attempt to improve this girl's life. Without it, she likely would have gotten worse.

My child underwent adenoidectomy when we discovered after a head/neck xray that his airway was almost completely blocked. He had never slept well, had ADHD diagnosis, was irritable, not growing properly, putting on weight, etc. He had been taking allergy meds since he was about 3, due to chronic nasal congestion due to "allergies".We did the surgery a few months ago and he is like a new kid. All those issues disappeared. He is 9. We had no idea that there could be such an easy solution. The surgery was the best thing we could have done. It wasn't without risks, but he was suffering and it was the right thing to do.

I suspect this girl had doctors who felt confident that her problems could be solved with this surgery. The family doesn't even have insurance, so it's not as if the doctor was doing this surgery to line his pockets.
 
I hate to say it but I expect it to get ugly. I would not be surprised one bit if her family tries to physically block the doctors and nurses from getting to the machine.

I think the same thing. Only an hour and a half until the deadline. :(

The difference is nobody has said the hospital absolutely isn't at fault, where you have said it is a case of malpractice. And for the record, I haven't seen anybody blame the family for this. Only saying that they aren't handling this in the best way. We all feel for them. Nobody wants to be in this position and many of us have said we don't know how logically we'd be thinking either if were us.

Does anybody have an opinion as to why the NY hospital made the offer in the first place? And why would they then decide not to take the girl? That to me is odd. They had to of known the situation. Do you think someone made the offer and then the lawyers got involved?

I don't think an offer was made at all. I think the family talked to the facility, the facility said no, but the family wouldn't admit the facility rejected them.

ETA: the judge has extended the order until 5pm on January 7th. The family contends they have a critical care place in NY willing to take her. No word on getting the trach or feeding tube placed.

Just edited my last post to update, but will do so again here. The judge has extended the order until 5pm January 7th. The family says they have a critical care place in NY willing to take her.
 
it's been extended until 1/7/14.

Not meaning to be gross, but her body won't last that long. What a disservice to her family.

From what they are telling the media, they truly believe she will wake up and have a chance at a life. :sad2:

At this point are any of her other organs functioning other than the heart on it's own and the lungs by use of the vent?
