I was married in June 2006 and still have not received my pictures. It is partly my fault, and I know I will probably get a lot of backlash from this, but I had not picked them out for about 2 1/2 years. Had a baby, was actually separated for 6 mths. (so had no desire to look at them), and lots of little things inbetween... so I never got around to picking them out. About 1yr. and 1/2 ago I tried to contact the photographer but got no response. I have e-mailed and called and left msgs. several times, all of which were documented... with no response.
What should I do now???? The pics. were paid for in advance, so they have their $, but I have no pics.
I don't really have the $ to hire a lawyer to put a threatening letter on his letterhead.

I would check to see if the photographer is still active and that the contact info is accurate. Then I would show up at his office/house (with a friend) and demand my photos or a refund.

HOWEVER...

Did you have a written contract? If so, did it say anything about not picking your photos up within X amount of time? Read the contract and be sure.

Did you pay by Credit Card? They may be able to help you dispute the charges.

By this time, it is likely he has disposed of your photos or wiped them from his harddrive (if digital) and not saved them. Check your contract with him first. If you did not have a contract with him, you may be out of luck altogether.

Nothing in the contract about X amount of time. I have 2 CD's with the digital prints on them as well as a digital slide show; however, the pics have the photographers name accross them to prevent you from printing.
 
Depending on how much you paid and what the state limits are, this may be a matter for small claims court, no lawyers involved. (Here it's for claims under $2,500)

You should have made contact sooner. But also, the photog should have said something to you about not choosing your photos after so long.

The photog is in the wrong here, no question about it. In order for him to win the case he would have to prove beyond a reasonable doubt that he made every effort to get you what you paid for. HOWEVER you may be limited by your state's statue of limitations, so there may not be anything you can do about it.

4 years is a long time to go without picking up your prints and expecting the photographer to store them for you that entire time. I hold for 2 years on a disk.

Is the photographer even still doing business?
