I am pretty sure my wife needed one especially since the name on her license didn't match the name on her birth certificate.

If you are wanting to get a passport with your married name, you won't be able to do it until AFTER you are married...
So, if you want to get it now, you will have to do it in your maiden name, but since it will be so new, they should re-issue one with your married name (I think you have like a year).
If you are needing the passport for your honeymoon, get it in your maiden name, but be aware that most cruise lines will then issue your stateroom card in the name on your passport (I just had this happen to me).
BUT, on the Disney Magic in January, while I was disappointed about having to use my old name on my stateroom card, I went down to guest services on the last day of the cruise and asked them to print me a card with my correct name, for the scrapbook, and they were happy to. SO, I wasn't sure if I could have done that earlier, seeing as how my Driver's License has my married name on it.
Hopefully this helps and you don't see my response as just rambling! :)

I am already married have been for 32 years , hence the lost licence, so where /how do I get a replacement?

It probably depends on where you were married. For us I would have to call the county clerks office in California where we were married. Do you remember what agency you got your marriage license from?

Congrats on being married 32 years! We just hit 10.

I just checked on the State Department's website, and I think the answer is - it depends.
First time applicants:
http://travel.state.gov/passport/get/first/first_830.html

If you're a first time applicant, it does not appear that you need a marriage license.

You will need to submit two forms of ID; one that will prove your status as a US citizen, the other to prove that you are who you say you are.

Acceptable documents proving citizenship:
Previously issued, undamaged U.S. Passport
Certified birth certificate issued by the city, county or state*
Consular Report of Birth Abroad or Certification of Birth
Naturalization Certificate
Certificate of Citizenship

Acceptable documents proving your identity:
Previously issued, undamaged U.S. passport
Naturalization Certificate
Valid Driver's License
Current Government ID (city, state or federal)
Current Military ID (military and dependents)

HOWEVER, if you're renewing a passport by mail, you will need the license, and even then - it's only needed if the name on the NEW passport will be different than the name on the old passport:
http://travel.state.gov/passport/forms/ds82/ds82_843.html

Hope that helps! :)

ok it was very simple I got it the same place I ordered our Birth Cert. from
VitalChek Inc the site is recommended by the passport site/ us goverment simple and painless except for the fee.

I don't think I needed to have my marriage license to get a passport. I think it was just an original or original copy of my birth certificate and my driver's license.

Thanks I read all that and still was unsure , and after I called there office and they were unsure I guess I will be better off to be safe than sorry .

I didn't need my marriage license to get a passport or when I cruise without it using just my BC. The last name is different but this is a common thing so they verified the birthdates on my license to the BC.

I did not need my marriage license to get my passport. You use your official birth certificate and government issued ID. Since almost all married women change their name from the name on their birth certificate, the State department marches up the date of birth and government ID for the name.

Another person chiming in that I was able to get a new passport with just my Driver's License and birth certificate.

You don't need it. :goodvibes

Although thanks to the lovely FL DMV I now need my marriage license just to renew my driver's license even though I was married 11 years ago and had my license reflect that in 1999. Asinine....but the FL gubb'ment usually is. ;)

In the state of California, yes, you need your marriage license.

I had my DL (married name) and birth certificate (maiden name). They asked for my marriage license to link that the person on the DL and the birth certificate are the same person, due to different names. Luckily, I had it with me "just in case."

Hmmnnn, I'm in California too and didn't need my marriage license. :confused3 I was applying for a new passport though. I don't know if that makes a difference.

Actually that isn't a FL specific rule for renewing your DL, that's the US Gov't rule and all states will be going that route with the implementation of the new and improved DL's that all states will be adopting. FL was one of the first to start this Jan. 2010 and others started following later in the year.
