Widow sues Disney

This story is just wierd. The man is a school teacher staying at the Grand Floridian?
 
Was this something the man did all the time????Did they frequently drink and argue????I sure would like to be a mouse in someones pocket in court,but unfortunatley disney will probably settle without a lot of publicity.How did they know the man was going to relieve himself??How did they know he fell???I am always amazed nobody sees anything yet they know what happened!If my husband had gotten drunk i certainly would not of called the manager about it ,that seems wierd to me too?I would look for him myself.It is a wierd story to me!
 
you have to wonder, was he going to relieve himself on the pier....???? maybe that's how they know..a state of semi undress...???
 
You know what Judge Judy would say..."but for HIS actions..."

In simple terms: he drank himself into a tizzy and wandered off a short pier. Unfortunately, it's HIS fault. I feel for his children and hope his misguided wife can forgive him.
 

He was his own liquor control board and obviously could not control his awful habit!

It's too bad the children have to suffer for his stupidity!

When I first read this thread, no one had posted yet. I almost posted then, but was afraid of the backlash it might cause if I said it was the guys own fault. Glad to see so many of my fellow DISers agree. We are all responsible for our own actions and he had the responsibility to either not drink or stop when he had enough. I'm sure he was impaired, but who got him that way? Disney who served the drink(s) or he who drank them? Did Disney force the alcohol into this guy? I don't think so. Would be interested to know what exactly he and his wife were fighting about. I think if there is a clear case of negligence, then suing should be an option. But people are too quick to blame everyone else around them for anything that goes wrong. Legally you do have a responsibility to yourself. Unfortunately, with all of the settlements just to make cases go away nothing will ever change.

This is almost as good as the people suing McDonald's because they failed to tell them that the food could make the fat if they ate there 3 meals a day everyday.

I'm will everyone else both in saying that I feel for their loss and am very sorry someone died....but also that this is ridiculous.

People are getting rewarded by our courts for being stupid, not being able to control themselves, not taking responsibility for their actions, and for not having common sense.

This is like the McDonald's suit where the woman sued because she was burned by hot coffee she placed between her legs while driving.

Since this will effect me, either by tax dollars or higher prices at Disney, I just want to go the on the record I'm tired of picking up the bills for morons.

Sorry to sound to mean, but let's have some common sense here.
 
Very well put Uncle Scar and I couldn't agree with you more. I am sick and tired of footing the bill for morons that should be getting Darwin Awards and not millions of dollars.
 
I just wanted to say that as to Castmembers overserving the fellow as a former bar waitress, sometimes it's not the bar staff's fault when someone is overserved. I have seen many times, when someone else would order a drink for someone that didn't need anymore and order it when they were away so the server didn't know it was for the overserved party. Also, there are people who are overserved, but you cannot tell they are overserved, until it is too late, they seem perfectly normal and then they get up to walk and it becomes obvious. Altho this can happen even after 2 drinks. If they were eating dinner, that would be taken into account by the server. At least when I was still waitressing we needed to take alcohol awareness as part of our annual license fee, where they explained the signs to us. Altho I have seen people overserved by bar staff even when they should be cut off, but ultimately the person doing the drinking needs to also take some responsibility for their actions.
 
It is truly sad that he had died at WDW but the fact remains that he was drunk and should not have been relieving himself off the end of the peir!!! I am getting tired of hearing about sueing for stupidity and a general lack of comon sense. I hear the faint sounds of Kching of the old cash cow.

I feel for the family but get real.

It's possible, maybe they got some type of code. Maybe the wife has a great job. Maybe they saved a long time for the trip.

I can't believe the wife would even think of doing this. I hope it gets thrown out of court.:mad:
 
it's been reaffirmed... that there are two things that the universe has no shortage of: 1) Hydrogen 2) Stupidity

The sad thing is that his children are missing a parent and are learning that things done in moderation are enjoyable while things done to excess can, sometimes, lead to unimaginable sadness, loss and pain.

I wonder why anyone, based on the evidence, would expose themselves and their children to more embarassment and pain when they won't get anthing close to what they're suing for. I guess, at least in some people's minds, is better than nothing.
 
A teacher can't stay at the Grand Floridian?? What kind of snobbish comment is that?
 
Good point, Uncle Scar. We all pay for these types of things.

Just posting to say, "ditto" to this being a foolish lawsuit. He was responsible for his actions, not Disney.
 
pnelson- You know darn good and well that was not the posters statement. I also thought it was surprising a teacher w/ 4 kids could afford to stay at the most expensive on-site property.
General observation and not seen by me as a snobbish comment.

Without knowing the circumstances I think no one has any right to say what someone can and can NOT afford...:rolleyes:

First of all, an adult is responsible for him/herself. She is more to blame then Disney as she didn't help her obviously incapacitated husband to his room.

The ONLY fault that might get Disney in trouble is the lack of a ladder from the water to the dock. MAYBE. Other than that, I see nothing wrong with Disney's actions. They were not responsible for him, the security guard did his job, went to get a manager, and when he returned and the guy was gone, he probably assumed he went to his room or found his wife.

Basically, when you are on vacation with your family, you shouldn't get so dumba$$ drunk that you are clueless. Where is the respect for your family? duh...

Basically, in this case... the court should throw the whole suit OUT and claim "survival of the fittest".

Actually, M&M Mom, I am real and just expressing my opinion that commenting on a "teacher at the Grand Floridian" is to me a foolish and snobbish comment. I would assume that many teachers have stayed at the Grand Floridian over time.

And obviously you have never dealt with an intoxicated adult who doesn't want any help at that time, is argumentative and basically just takes off. Some of you would benefit from an open Alanon or AA meeting based on some of the insensitive comments being made here.

Personally I don't agree with the suit. Florida law, as it stands now, based on the alcohol factor alone, the case would not go far, but you throw in some other safety factors and perhaps it's enough that Disney will just settle it out of court to be done with it.

It's not about whose fault it was.
It's not about the alcohol.
It's not about the pier.
It's not about the lack of a railing.
It's not about the fight between the husband and wife.
It's not about who can afford to stay at the Grand Floridian.












IT'S ABOUT $$$$$$$.

Disney has deep pockets, and an overwhelming desire to protect its image from anything negative.

I don't think that even the lawyers for the plaintiff ever expect to go to trial on this one.

I imagine the conversation went something like this, "Listen, lady, sorry about your loss. You know, nothing will bring your husband back. But, we may be able to get you a nice chunk of change to help with raising those four kids you are now left with. See, Disney has mega-bucks, and will pay anything to make a nasty lawsuit that may damage their reputation go away . . ."
