What to do, what to do (custody related)**HAPPY UPDATE #28!!!**

Well, we have put together our proposal, but not sure what to propose for child support. We figured mom would have her 60 days a year. We figure that right now, we have her for 110-120 days a year, and pay $325 a month (and claim her on our taxes every year). Can anyone give some help here?

Also, this is our (first) proposal. And input will be helpful!

Primary placement with DH will be no later than August 1, 2006
DH will claim DSD for taxes for 2006 (due to us paying 7 months of CS, her mom paying 5).
Parents will split the cost of plane tickets for summer, spring break, and Christmas break. Parents will decide together where the flight originate from and fly into.
If mom requests any other visitation, she will pay for the plane tickets.
Length of stay for visitation will be determined by school schedule, who gets her for which holiday, and mom's work schedule.
 
this post has beena wonderful help. I wish my Dh would get on the ball to his ex and try to get their DD living here with us. She will be 12 in June and I'm hoping we can get something started. I don't know what we'll ahve to do with the courts to try for custody but her mother drives us crazy. She won't do anything to take care of her except buy her clothes. We take her to the DR's, Dentist's, Eye Dr, and anything else she needs to do. her dr's are all up near us and her mom won't even take her to the emergency room if she is really sick, she calls up my Dh to come pick her up and take her. SDD new eye glasses were ready almost 2 weeks ago and her mom won't even go pick them up with her. They are fully paid for and just have to be fit to her face. It is also only a 15 minute drive from her place to get them.

I hope my Dh realizes that she would be much better off with us.

You should have called the cops and reported no one being home at the scheduled time for your DSD to be dropped off, this way if you go to court it can be used against her. DOCUMENT EVERYTHING!!!! I say this from experience. My ex took me to court to try and take DD10 away from me, and I documented everything. When I showed him all the stuff I had documented he never showed up and the case was closed. Good Luck!!!!

DH brought it up to her, she said we told her we were dropping her off later (um, don't think so!)
 

It isn't court ordered visitation that states DSD will be dropped off at such & such a time and picked up at such & such a time & day????

My sister works in family court. My DH and I have also had issues with my DSDs. My Dsis told us that only volatile situations, where agreements can't be made, do they necessarily put the time stipulations. She said that believe it or not, most divorced couples can amicably agree to time parameters without the court stepping in. Of course she did have one case where they actually went to court over boxer and briefs. Sorry, that's OT but I thought a humorous little side note. :rotfl2:
BabyTigger - good luck with everything. I think you are right. Once you get DSD living with you she won't want to return to her DM. Kids really do crave the stability!
 
Child Support!!! I have a feeling we are going to have to bring this through Court, although, if we do, it may end up better for us (especially after the Court sees her income as compared to ours). This could get ugly!
 
We DH, DSD, and the ex all met on Friday. Things are a go! Just have to write up the paperwork and submit it to the Courts. DH would have liked child support to be a little more than it is, because we will have her more days a year than her mother currently has her (we just flipped everything around), so we are going to mark on the calendar the days her mom will have her. Everything changes on August 1st!

I did my best this weekend to get DSD excited about the move. She is nervous, but that is understandable. I told her that we will have a "girls day" before school starts, get an outfit for the first day of school, take her to the school (which is where I went to middle school), show her around, see if we can meet the teachers, get a haircut, get some new shoes, etc. Then, she got really excited when I told her that we are going to go through her clothes that she brings up from her mom's, get rid of what is worn out, doesn't fit, or she doesn't wear, and get her a new wardrobe (her mom tends to buy her stuff that is too small for her and doesn't fit her right), and show her how to wear what looks good on her. She is soooooo excited!

On the bad side, she tried to get a hold of her mom all day yesterday, to find out when she could meet DH to switch. Never did get a hold of her. DH had to drive all the way to her house (about an hour and 20 minutes away), and drop her off at her aunt's (DH's sister) house. DSD told DH her mom was at home, but she just wanted to go to her aunt's. DH drove past mom's house, no cars in the driveway, called her, no answer, so someone is hiding something. Oh well, a few more months, and we won't have to deal with this anymore!
