I hope she heard a "Click!" at her end of the phone as he hung up on her. Tell him not to answer the phone to hert anymore. I'm glad he got the money owed to him. That should be the end of it.

He says he told her, "No, there is no problem. The check was cashed and there was no problem with at all!".
I hope she has enough sense to let it go but I know her history and nothing would surprise me.

If you don't deposit the check, there is no legal recourse. When I threatened to have the lady above arrested, the letter I sent included her needing to pay the check AND all of my associated fees for it bouncing.

And here, when you do file to take them to court for the bad check, you can ask for and receive up to triple the amount of the check plus any and all fees. Bank fees, court filing fees, certified letter fees.

One of the places I worked, use to have a sign that said, all returned checks are issued a $25.00 fee, then sent to court for triple damages. Had a copy of the NSF check, the court paperwork with the amount filed for and a copy the cashiers check showing us being awarded almost $5000.00 for a $1000.00 bad check, hanging right next to it.

We didn't get them very often and when we did, the customers brought in cash to cover them right away.

Since you are having this much trouble getting his last paycheck, perhaps you should request an itemized earnings statement for your records. Sounds like she won't be around business wise when tax season arrives.
