Alamogordo, NM-- Can "free speech" go to far, when it targets someone specific?

A New Mexico man's decision to lash out with a billboard ad saying his ex-girlfriend had an abortion against his wishes has touched off a legal debate over free speech and privacy rights.

The sign on Alamogordo's main thoroughfare shows 35-year-old Greg Fultz holding the outline of an infant. The text reads, "This Would Have Been A Picture Of My 2-Month Old Baby If The Mother Had Decided To Not KILL Our Child!"

Fultz's ex-girlfriend has taken him to court for harassment and violation of privacy. A domestic court official has recommended the billboard be removed.

But Fultz's attorney argues the order violates his clients free speech rights.

"As distasteful and offensive as the sign may be to some, for over 200 years in this country the First Amendment protects distasteful and offensive speech," Todd Holmes said.

The woman's friends say she had a miscarriage, not an abortion, according to a report in the Albuquerque Journal.

Holmes disputes that, saying his case is based on the accuracy of his client's statement.

"My argument is: What Fultz said is the truth," Holmes said.

The woman's lawyer said she had not discussed the pregnancy with her client. But for Ellen Jessen, whether her client had a miscarriage or an abortion is not the point. The central issue is her client's privacy and the fact that the billboard has caused severe emotional distress, Jessen said.

"Her private life is not a matter of public interest," she told the Alamogordo Daily News.

Jessen says her client's ex-boyfriend has crossed the line.

"Nobody is stopping him from talking about father's rights. ... but a person can't invade someone's private life."

For his part, Holmes invoked the U.S. Supreme Court decision from earlier this year concerning the Westboro Baptist Church, which is known for its anti-gay protests at military funerals and other high-profile events. He believes the high court's decision to allow the protests, as hurtful as they are, is grounds for his client to put up the abortion billboard.

"Very unpopular offensive speech," he told the Alamogordo Daily News. "The Supreme Court, in an 8 to 1 decision, said that is protected speech."

Holmes says he is going to fight the order to remove the billboard through a District Court appeal.

Pesonally I think its wrong especially as the friends say she miscarried rather than aborted.
 
He is reprehensible. He now admits he doesn't know that she actually had an abortion. He has changed his story so that now it isn't specifically aimed at her, just Pro Life and Father's rights...uh huh. In fact, she had set up a page on Babycenter dot com saying how excited she was.

Poor girl, like breaking up and then losing a baby wasn't bad enough.
 

I think I'd take out a billboard saying that he was lousy in bed. :)

Plus, if she did miscarry, and he can't prove she got an abortion anywhere, it's libel. I'd sue.
 
I would go a step further and say that he is not very well endowed. Shameful really.

The article quoted doesn't specifically say whether he put her name on the billboard.

If he didn't put her name, he's a jerk, but within his rights to free speech.

If he put her name on the billboard, I think he's crossed the line.

I think it is disgusting whether she miscarried OR had an abortion.
its an invasion of her privacy and really a despicable thing for a person to do.
 
What a jerk. This is the kind of loony crap that then gets roped in to make it look like every pro life person is an unhinged moron.
 
I think that this takes break up drama to a whole other level, it is sad for the woman and he is clearly a jerk.

This does bring up the elephant in the room - the father who has no rights to decide if the baby is aborted. I do not claim to have a solution to this one.
 
I think the bilboard crossed the line. As a pp mentioned though if she had the abortion against the father's will I think that is a problem and needs to be fixed. I am 100% pro-choice but I feel both parents should have equal say in the decision and if there is a disagreement they should err on the side of birth (no matter which of the two parents wants that outcome). I have no idea how that would be legislated though so don't ask me.

In any case the way to respond wouldn't be to take out a billboard.
 
He is a jerk for doing this. It's not really any different from the stuff the tabloids say about famous people. Yes I think it is wrong but it's not illegal if it was there wouldn't be tabloids.
 
It's free speech and it's protected in our country. Issues like this are the price we pay for our freedom of speech.

If she wants to sue for libel or slander, she's perfectly welcome to do so. However, if she did have an abortion and it somehow could be proven that he definitely was the father, then I don't see how she could win because what the billboard said wasn't libelous or slanderous.

That is a great point. I don't think celebrities should have any less right to privacy then anyone else yet people don't get all up in arms when their private lives are splashed all over. We are a nation of hypocrites when it comes to privacy IMO. We love to know all the gossip on other people but God forbid something we want to stay private gets out into the open.

I agree with this too. It said the billboard just said 'the mother' not 'Jane Smith'.

If she miscarried, I feel very sorry for her. If she didn't? Then I really don't. With the medical privacy laws in place there is no way this can be proven either way.

Good point. Unless she's willing to release medical information, any court case would turn into a he said/she said issue.
