Getting put on the Sex Offender/Violent Person list is not automatic. There has to be a separate hearing on the matter, and the judge has to find the person deserves to be on the list based on the offense and the likelihood of recidivism. It's not an easy standard to meet. It's very unlikely someone would be put on the registry for accidentally showing his ***** while urinating. It could happen, but doubtful it would meet the standards for registration unless the judge is an idiot. And the case would most likely be appelled if it were ordered.
That really depends on the state, and sometimes the county. In PA, you can be put on it for non-intentional exposure up through violent sexual attacks-and the list doesn't tell you the reason. You have to look up the person and the code they were convicted under, and those are often broad enough that you still have no idea what really happened. Unless things have changed to be more lenient in the three years since I have moved from there (which is unlikely) any sexually linked crime automatically put you on the list.
