Weird odd Offender Registry situation?

Getting put on the Sex Offender/Violent Person list is not automatic. There has to be a separate hearing on the matter, and the judge has to find the person deserves to be on the list based on the offense and the likelihood of recidivism. It's not an easy standard to meet. It's very unlikely someone would be put on the registry for accidentally showing his ***** while urinating. It could happen, but doubtful it would meet the standards for registration unless the judge is an idiot. And the case would most likely be appelled if it were ordered.

That really depends on the state, and sometimes the county. In PA, you can be put on it for non-intentional exposure up through violent sexual attacks-and the list doesn't tell you the reason. You have to look up the person and the code they were convicted under, and those are often broad enough that you still have no idea what really happened. Unless things have changed to be more lenient in the three years since I have moved from there (which is unlikely) any sexually linked crime automatically put you on the list.

Our state sex offender/violent person registry tells what the charge was which got the person placed on the registry. If it's Child Molestation, Sexual Misconduct with a Minor, Rape, whatever, it will list it on the page with the person's demographics.

I work in probation, and see our county's sex offenders on a regular basis when they come in for their appointments with their officer. They are some of the nicest people (well, not the violent offenders obviously) you'll ever meet. They're really good at being friendly, which is how some of them groomed their victims.

When I was hired, they considered me for the sex offender supervising officer or as a juvenile delinquent supervising officer. Boy am I glad I got the juvenile position. I have to deal with the juvenile sex offenders, but there are fewer of them than there are adult sex offenders in our county.

The NC Sex Offender Registry just lists the date of conviction, the mug shots, and the crime. In his case it was indecent liberties with a minor. He is in his 40's.

For anyone wondering what that means, the NC statutes say:
§ 14-202.1. Taking indecent liberties with children.
(a) A person is guilty of taking indecent liberties with children if, being 16 years of age or more and at least five years older than the child in question, he either:
(1) Willfully takes or attempts to take any immoral, improper, or indecent
liberties with any child of either sex under the age of 16 years for the
purpose of arousing or gratifying sexual desire; or
(2) Willfully commits or attempts to commit any lewd or lascivious act
upon or with the body or any part or member of the body of any child
of either sex under the age of 16 years.

I agree that the show should be removed from viewing. I think you should consult a lawyer before posting any reason why.

As far as the ministry is concerned, I think I would talk to whoever is in charge, be it an individual or a committee and make them aware of the situation. This is a serious matter and should be brought to their attention. He may be dismissed from his duties, but they may not want to reveal the reason.

Most people deserve a second chance, but you can't be too careful when it comes to children.

If your host knew the guest's past, and didn't let you know and had him around your children, I'd have a problem with that too.

I totally agree with all of this, thanks so much for posting! Just to clarify, our host did not know about this part of his past. I gave an example of how mad I would be if he had known and didn't tell me here in my posts. But he did not know and was just as blown away as we were.

Well. .court documents are usually public. Hustle on down to your local courthouse and ask how you get a copy of those public records. If it really is a case of the girl walking in on him while he was peeing. . .then you can judge that however you will. However, it is just my experience, that people don't plead guilty in these cases. Find out the details. . .and once you do. . .I think you have a moral obligation to set the record straight with your listeners. JMHO

BTw. . my brother is a prosecutor and has worked sexual assault and family violence for the last 20yrs. Get to the bottom of the case! You owe your listeners the truth.
