WDW May Be Enforcing Smoking Fines

DSis just returned from WDW. She was sitting in the smoking section at the BC and a CM told her that it was smart of her to be smoking in the smoking section because two different families were caught smoking on their balconies the night before and were both fined $500 that was automatically charged to their credit card. If this is true, it seems that WDW is enforcing the smoking rules. I've read that WDW had a right to fine guests but this is the closest confirmation I have heard of it being enforced. This is not a big deal to me personally since I am a non-smoker in which smoking does not bother me in open spaces but I thought others may find this interesting. I do have one question - How is WDW able to enfore the fine? Is it stated on the reservation? Our ressie from our August stay was printed before the new policy went into place. I went through all of the information that was given to us at check-in and there was no mention of a smoking fine. At check-in, we were told that all rooms were non-smoking but no mention of a fine. Just my legal mind at work again. And pleeeeze, do not make this an anti-smoking thread. I am just curious if anyone can confirm that fines are being imposed and if guests are given notice at or prior to check-in so that the fines will be enforcable.
 
Disneyhappy - this probably will turn into a debate, which means the thread will be locked, but I thought I'd try to answer your question.

When we checked into our resorts this summer (BWI/WL/YC/GF), each resort asked us to initial or sign a paper, and on that paper there was an agreement that we would be charged if we violated the no-smoking policy. It's the same paper that we've always signed in the past, during check in, but it now had that caveat added. Since the CM kept this paper for their records, you may have signed it without noticing. Some CMs pointed it out, some did not, but I noticed it on all that I signed.
 

I have a question. I understand they can fine you and should if that is the policy. My question is , can they just put it on your credit card? I would think that would not be allowed unless you signed that THAT is how the fine would be paid.
 
That's why it is important to read any documents before you sign them. :scared1: I hope Disney is enforcing the no smoking policy. Smokers Beware:rolleyes1

I know I've seen the information about the smoking fines on confirmations for packages.....I don't know about room only sheets.....

It has to be "in the fine print" somewhere that thats the case. Obviously most people would not be happy about this, and not willingly part with 500 bucks (although I'm sure they spend much more than that on cigarettes annually :rolleyes1 )

I used to work for a rental car company, if you ever look the entire back of the agreement is the actual text of the contract...probably something similiar at Disney...they have their bases covered in case people try to do a chargeback with the CC company I can assure you.
 
On my emailed confirmation, just a excerpt is on it reading:

This resort is a smoke-free environment except for designated outdoor smoking locations. A $250 - $500.00 room recovery fee will be charged for smoking in Guest rooms, on balconies, or on patios.

I'm sure it goes into more depth on the paperwork signed at check-in. However, every CM should point it out and stress it.
 
I do not think they should do that if they are on there balcony but definetly if they are smoking around the parks!pirate:

I completely respect your opinion, however I do think they should include balconies. We were at CR last week, on or balcony, enjoying the view. Someone above us was smoking, and it wafted down to our balcony. I found it disgusting that I had to be subjected to that, and even more annoyed that my four year old had to be subjected to it.
 
There are also signs in the room itself about the no smoking policy and the fee associated with it

The only smoking allowed at the resorts is in a designated smoking area. So yes, the fine would apply. Many people complained about others smoking on the balconys of non-smoking rooms, which is part of the reason for the designated smoking areas. You either are in an area, or you are not. Not much room for debate or interpretation anymore.

both hubby and i smoke, we smoke in allowed areas. but i am wondering how they know if you smoke in your rooms? do you have to be caught at it? but since we do smoke, i am sure we smell like smoke, so if we come back into our room smelling like smoke, are we going to get busted for smoking in our room?

i hope this made sense.
 
I have had to sign at check in at a non disney hotel that we would not smoke in the room and would be charged a cleaning fee if we did. I think it was $200.

I agree with the no smoking on the balcony rule. One year (before the non smoking policy) we were on our non smoking room patio at the WL and had ashes dropping down on us from a room above!

The cigarette smoke wafts through the vents to the next rooms and non smokers will be able to smell it. I'm sure CM and other guests will not find the smoke smell on you intrusive. It won't get into the carpet and drapes, I mean. BTW, we smoke also and am looking forward to the non smoking on balconies, as I don't smoke around non smokers We may be setting up camp at the smoking area on this next trip, though!

on our last trip we always called it the "smokin bench" and we smoked our way around the world in epcot.

well i won't worry then. because we smoke in desginated areas.
 
We stayed at BCV this summer, & upon check-in there was paperwork stating that if guests smoked in the room, there would be a "room recovery" fee. I remember commenting to DH about it.

Just wondering how it/if it were possible for you and your dear 4 year old to hang around and use Disney bus transport???...those fumes are certainly not light-weight!!!
