I think it only depends on whether you were actually arrested, or if it was a conviction or something that went thru the court process. (ie. points for speeding wouldn't count (I think!) unless perhaps you got so many you were banned), however, I'm not 100% sure about that.

Check out the Visa information on the US Embassy site which includes a link to the 'special restricted visas' details as well. It gives lots of info, including how to get a special Visa if that's what you need. If you can't find what you are looking for, or are in any doubt, you should ring the Embassy direct - there is a Visa helpline I believe.

I am not sure what the full criteria for this is but I have just looked up some info for you on the website for the US Embassy here in London:

Note: Travelers with minor traffic offenses which did not result in an arrest and/or conviction for the offense may travel visa free, provided they are otherwise qualified. If the traffic offense occurred while you were in the United States, and you have an outstanding fine against you or your did not attend your court hearing, it is possible there may be a warrant out for your arrest, and you will experience problems when applying for admission into the U.S. Therefore you should resolve the issue before traveling by contacting the court where you were to appear. If you do not know the address of the court then information is available from the Internet at: www.refdesk.com.
