Virgin paid out compensation - now able to go back to the world!

Great result, a couple of questions - we've lived out of this jurisdiction for over 10 years so I hope I don't sound stupid:

Is there a statute of limitations on claiming?

Does it cost anything to take the legal action? Is it through the Small Claims Court (not even sure if there is still such a thing)

The rules state that you have to make a claim within 6 years and if you were to make a court claim this also has to be done in that period I believe.

I raised a small claim via MCOL the cost is dependant on the amount so I paid £80 for a £2028 claim - Virgin refunded the court cost .

I claimed for the entire family at the time of the flight we were 2 adults and two kids (11 &9) I was able to claim €600 each. I needed to fill out separate forms but as far as the legal side was concerned one claim for all was fine.

I am happy to answer any questions via PM if people need details, however, I followed guidance and template letters from a well known consumer site (not sure if I can say the name??? Mods?) so I would direct people there as there are lists of flights where money has and has been paid and oddly enough there are lots of people claiming on Orlando flights.

There are typical companies who will do the work on a no win no fee basis for 30% of the award plus other fees - personally I found it very easy to do.

I had a ridiculously delayed flight with Travel City Direct back in 2007 I think. Do you think I'll be able to do anything about that with Virgin owning it now?

Virgin only took on their database & website, none of the liabilities if I remember correctly.

As someone who claimed back thousands in banks charges 6 years ago - I still bank with the same institution and they have offered me premium services and products so in my experience not a major problem.

But as you say it is a consideration people may need to make.

Although - with the prices Virgin charge cannot see us using them in the near future!!:rotfl2:

Although its possible David I doubt many companies can afford to make a stand like that, a payout of £2,000 would be recouped in no time, they would lose much more from declining a customer.
 
Looks like I may be doing the same, picked up a 24 her delay with virgin today, the pilot went sick and they could not find a replacement. Given that gatwick is their second biggest base and the biggest is 50 miles away, I don't think this counts as an extraordinary circumstance. Will be moaning at virgin on my return. Have to say though we have been well looked after by the ground crew. Night in Hilton, dinner and lunch voucher.... don't make up for loosing a day off my hol though!
