This is not as much seeking advice as it is venting frustration. My step daughter is a server in a restaurant. When they went to carry out/drive thru only she told them she wanted as many hours as possible. This was before unemployment rehab were relaxed. Now she is trying to get laid off but they will not do it. She is bringing home $200 a week. Then today they had several employees say they are sick. They closed for 2 weeks and will pay them. Obviously they will not lay them off if they will have no workers in 2 weeks. She has called the unemployment line but they are so bogged down they are telling people they will call back.

I just feel these businesses are forcing people to continue to work in unsafe conditions. Once they have positive cases they should close till this is all over.

Thanks for letting me get this off my chest. We are very worried.
 
She should still be able to apply. Unemployment isn't just for unemployed people, but underemployed as well (at least for CA)
 
Having reduced hours counts in PA. Getting paid for time out of work doesn't count. Is there a website to file from? She should look into it once she is no longer working/getting paid.

She is waiting for a call back from them. In our state they ask you to file a detain day of the week by last name. Her day is tomorrow so she is planning to but needs answers. I said go ahead and apply. Worst they can do is say no

That's not exactly accurate. I know of someone they went after because their company misfiled when the worker came back off unemployment, so Unemployment showed them getting paid and claiming. They ended up having to pay it back for those weeks because they couldn't prove when they started back at work as it was a year or two later. As long as the info in the application is correct about the amount she is working she should be ok though. They do send the info to the employer though so they can dispute anything not accurate. Just be prepared for that if they are as bad as they describe.

Right, I just meant she could get the application started while she waits for the call. Our governor tells us every day to file. I’m kind of hoping after the 2 weeks they will let her take a lay off. Maybe after being closed people will stop going there and they won’t be able to stay open. Terrible to wish that but I care more for her safety and she has a 5 year old to worry about too.

For the record we have told her we won’t let them go without.
 
I have a question on the $600.00 weekly check from the federal relief law...if you get your hours reduced due to Convi19 and work for a company that has more than 500 employees, are you still eligible to get the $600.00 weekly check? Someone told me that in order to receive the $600.00, your company has to have less than 500 employees? Is this true?

I got something from my employer which mentioned 500 employees. I don’t understand it at all

The FFCRA gives businesses with fewer than 500 employees (referred to throughout these FAQs as "Eligible Employers") funds to provide employees with paid sick and family and medical leave for reasons related to COVID-19, either for the employee's own health needs or to care for family members. Workers may receive up to 80 hours of paid sick leave for their own health needs or to care for others and up to an additional ten weeks of paid family leave to care for a child whose school or place of care is closed or child care provider is closed or unavailable due to COVID-19 precautions. The FFCRA covers the costs of this paid leave by providing small businesses with refundable tax credits. Certain self-employed individuals in similar circumstances are entitled to similar credits.

Did her emoloyer deny it? They do pay toward EU so they can fight it if so inclined.

It might be the same issue we have in WA that was discussed on the news last night. They are still updating the software to acknowledge jobs that generally aren't accepted for unemployment. I think they are getting automatic rejection without an actual person even seeing it because of this. It'll be retroactive but I underatand the annoyance but also the states systems aren't set up nor expected to handle needs they are now seeing.

Are you in Colorado? If so, my daughter tried filing but she was rejected because her employer still had her listed on the payroll (hourly employee). She had to ask them to furlough her so she could try to get benefits.

no, KY. Her employer won't lay her off. Now they are paying her for 2 weeks. They have to according to the new FMLA law passed April 1. Hopefully after the 2 weeks they won't reopen and she won't be forced to go back to work.
