UGH!!! This really stinks....

O.K. About 3 years ago DH was involved in a medical malpractice case and the defense counsell wanted him to get examined by their doctor. We really had no choice according to our attorney, so we reluctly agreed. We went and had the exam, with the understanding that defense counsel wad responsible for this bill. We went to court 2 1/2 years ago, and WON!! So, today I get a call from the doctors office that defense counsel wanted us to go see, telling me that we have a LARGE outstanding bill and that if we don't pay it they are going to send it into collection!!! Now, we are not responsible for the bills and I told the lady on the phone that. I'm sure she's heard all sort of stories, but I'm telling the truth. She said, well didn't you get all the bills we've been sending, and I said no. She asked for my address, which I refused to give her, and asked where the bills have been being sent. Well of course they were being sent to defense counsel!!! They haven't paid the bills!!! Well, she said it was our responsibility and if it is not paid, this bill is going to go into collection. We've contacted our attorney and they said it was going to be taken care of, but I'm still shaking!! We ALWAYS pay our bills, and don't even keep balances on our credit cards!! We pride ourselves on our perfect credit and want to continue tthat, but with crazy stuff like this happening, how can I control it!! I'm sure it will all work out in the end, but I'm still mad at the whole thing and the "mean" bill collector lady!!!
 
Ah yes, the "defense independent medical exam." I work for plaintiff's attorneys and we always have a problem with these exams being paid for by the defense. Just be persistent.

Trust me, if you bug your attorney enough, he'll handle it. Make sure to document whenever you have contact with anyone regarding this matter. Write a letter to the doctor's office explaining the case. Point out that this was an IME at the other side's request....thus, you are NOT liable for it. If there's a problem, then they should take it up with the defense attorney.

Persistence is the key here.
 
Just wanted to wish you luck. And keep track of all calls and correspondence. It's amazing what happens when you can refer back to a time, date and name.
 
Well, my attorney called this"bill collector" and she got nasty with her!! She actually hung up on my attorney. Well, now my attorney is peeved and is sending letters to everyone involved. Hopefully this will get fixed very soon!!!
