I think they already have been.

Each song comes out to $1.07 for me which is exactly what $.99 plus WA State sales tax comes out to.
 
I like in the article how they say anyone who has bought an iPod paid a sales tax. Not me.

But should you be able to tax an intangilbe, such as a digital file?

Not debating whether or not there should be a tax, software is generally considered a tangible good by taxing authorities while software support and maintenance is considered non-taxable. Software (and digital files of music) is code (a thing) after all.
