The FINAL (?!) Jodi Arias thread (Penalty Phase retrial verdict)

The link below is to a sentencing memorandum to the court "respectfully requesting" that Jodi Arias be sentenced to Life in Prison with the possibiity of parole after 25 years, not LWOP. I didn't read it all, but it does make me nervous that Judge Stephens might cave. And I'm guessing that Nurmi and Willmott yapping away is going to take up a large part of the sentencing, altho Juan Martinez will do his damnedest to counter all of it. I wouldn't be surprised if this runs into Tuesday!

It's 27 pages long, including about 20 pages describing 60 examples of cases where the defendant didn't get LWOP. One of their points is that some defendants charged with 1st degree murder accept a plea deal to a lesser offense and, according to the memorandum, the prosecutor refused to offer a plea deal. But remember that Jodi wrote a letter long before trial, saying that she would accept a plea deal of 2nd degree murder or something, and in return her "gift" would be that Travis's name wouldn't then be dragged through the mud? But there was no reason to give her a plea deal of less than 1st degree murder...the evidence of premeditation was so overwhelming. There could be numerous reasons why others were offered plea deals. The case against Jodi Arias was pretty darn good.

I'll read through it all over the weekend. I just realized that I said in my previous post "Less than two days." DH was home half the day because he was getting his fishing stuff together, and it threw my days off.

Thanks for the link, Mare. I looked at the document, and there were a bunch of defendants that plead to M1 and received the 25 or 35 years to life sentence. I hope that Arias gets LWOP. All of her lies and manipulations will come into play. She has lied over-and-over again. Also, she has not been a model inmate at the jail. She tried to submit evidence that she faked. All of this will work against her. I hope Judge Stephens does the right thing.
 
Here's the plea deal request...it makes me sick. Right before the "conclusion" it states:
"Ms Aria is willing to resolve this case in the manner described above because she has grave regrets for the falsehoods she told the media after Mr Alexander's death and how such falsehoods might have caused the family even more pain."

Well, isn't that just so GOOD of her. smh She's been on a mission to torture the Alexander family since the day she tortured and murder him.

I've gone over to that site a few times, and those people are a few cards short of a full deck. They still believe she is innocent. It's just nuts. The woman butchered another human being.

She's so in denial about everything too. The jurors didn't buy her BS about her being the victim, and hopefully Stephens won't either. But who knows what lurks in the mind of that judge.

I could kick myself. Snapped was on at 6 and 7 and I thought it was the same episode, repeated, so I only set the DVR to record at 7. But it's part 1 and part 2. So I missed part 1, which showed some of her interviews with Detective Flores. Oh well.

Is Jodi Arias spending her last night at Estrella jail tonight--her residence for the past 7 years? I say yes, and predict she will be transferred to state prison at Perryville tomorrow, not the following day. Arias's sentencing hearing is tomorrow and is scheduled for 8:30 a.m. in Phoenix. It will probably finish before the lunch hour. Family from both sides are permitted to speak as well as Arias, if she chooses. Is there anything Arias could say to convince the judge that a life sentence with possible release after 25 years is the appropriate sentence? Nope--nothing.

Do we know exactly where to watch this? I wonder if HLN will carry it. Except with commercials and that friggin' pause button so that they can analyze what we're hearing, I don't think I could stand it. Gotta get a streaming site lined up. Not sure if there's one already posted here? (And did *I* post it? lol)

On Monday, April 13 KTAR News 92.3 will air a special two-hour edition of "Legally Speaking: The Jodi Arias Trial" from 7-9 p.m. with Monica Lindstrom, Mike Russell and Martha Maurer.

We can finally close the chapter, though not the book, on the Jodi Arias trial…or can we?

Monday morning is supposed to be D-day for Arias. It's the date scheduled for her to be sentenced by Judge Sherry Stephens.

When the second jury failed to reach a unanimous decision on life or death, the decision of Arias' future fell squarely in the lap of Judge Stephens. When the non-verdict was read on March 5, it appeared Judge Stephens was prepared to sentence Arias on the spot for the brutal and horrific murder of Travis Alexander but the defense requested a date at least 30 days out.

What will happen on Monday? I can't tell you what exactly will happen but I can tell you what is expected to happen.

As you probably know by now, this trial has always been unpredictable and I don't see the pattern changing.

It's expected Judge Stephens will call the matter at about 8:30 a.m. and the entire thing will start with a sizzlebar (which is what I have been affectionately calling the many sidebars with the white noise).

Then we should hear from the prosecutor, Juan Martinez, who will give Judge Stephens the many reasons why Arias should receive natural life with no chance of ever being released from the Arizona State Prison System.

I find it highly likely we will hear from Travis Alexander's family. Both juries and Judge Stephens heard the anguished, angry and sad words from Alexander's brother Stephen and sister Tanisha, and it wouldn't surprise me if we hear their moving words again. I don't anticipate any other witnesses for the state to speak in court.

The biggest mystery is what will the defense, led by Kirk Nurmi, present to Judge Stephens in order to secure the possibility of parole.

I know Nurmi will speak, perhaps even his co-counsel Jennifer Willmott. After that, your guess is as good as mine.

In the penalty trials it was only the attorneys and Arias herself that spoke (Arias addressed the original jury but not the second one.) It was reported Arias' mother wanted to speak but she was not allowed so we might see her or another family member speak on behalf of the convicted murderer. Arias herself may choose to speak her peace to Judge Stephens, although I wonder what she could actually say that she hasn't said before.

At the end of the day it's anticipated Judge Stephens will sentence Arias (there is a possibility it takes more than one day).

I predict Arias will be sentenced to natural life in prison.

I will be in the courtroom and will tweet the decision out when Judge Stephens hands it down.

TODAY.IS.THE.DAY. Can't even imagine how this will all play out. We could've probably had a whole list of polls about what happens, today, and after today. I do have a feeling we'll see Jodi's mother speak on her behalf. We'll see.

I wonder if, after this, there's going to be any more discussion or any repurcussions against Judge Stephens or some of her decisions, like allowing Jodi Arias to testify in secret.
