Terms of Use Disney Characters

Hi Everyone,

I know that many DISingers say that we can all use the Disney characters as long as they are not used for profit. I have a bakery/printer who is refusing to print my item as it uses Disney characters that I have photoshopped together for my son's cake (Jake and the Neverland Pirates)

Can anyone tell me HOW we know that we can use the Disney characters? Is there a letter or a section in their copyright or something?

Any business or individual that would charge you for an item with a Disney character must have a license from Disney to do so.....a baker, a printer, etc.

That is why all the stuff sold on Ebay and Etsy is undoubtedly ILLEGAL!! There may be exceptions that are very legally technical....if you buy licensed fabric and make something from it, can you sell it? I don't know.

You can use Disney images to make something for yourself but the baker is right in refusing to violate Disney copyrights.

I don't have a letter regarding this but I do know someone contacted Disney to clarify the validity of using for one's own use.
 
Well, I don't personally know Disney's rules but I do know that businesses will NOT print anything that is copyright. They are doing this to protect themselves. Most people don't really have a problem here because they are printing all of their things at home not outsourcing them to someone else to do for them. I'm sorry you are having a hard time with your baker/printer. My suggestion is to have a "plain" cake and perhaps have your designs made into cupcake picks which you can make at home and put them in a few cupcakes so you can still use it. Just throwing my 2 cents out there. :goodvibes
 
Thanks for your replies. I appreciate you taking the time to respond. What you have said makes sense.

I am making pirate cake pops and was hoping to have an edible cake image on a plain cake as my son really wanted Jake. (they don't like cake pops - too sweet) I have a friend who works in a bakery, hopefully she can print it for me, if not, back to the drawing board.
